1 <br />0 <br />BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF JANUARY 9, 2023 <br />ROLL CALL <br />Mr. Papotto called the meeting to order at 7:02 p.m. in Council Chambers. <br />Present: Bob Papotto, Ralph Mackey, Dan Rahm, Suzie Patton, Michael Kovach <br />Staff: Law Director Michael Gareau, Jr., Director Upton, Building Coordinator Katie Seeley, <br />Special Assistant to the Mayor, Chuck Massarolo <br />RESIDENTIAL APPEALS AND REQUESTS <br />22-23509; Justin Leaf -Clark; 25870 Kennedy Ridge Rd; <br />Proposal for a second story garage addition with living space <br />Representative: Kiernan Weese on behalf of his client Justin Leaf -Clark <br />The following variances are requested: <br />1. A variance for a second dwelling on a parcel zoned One Family Residence; code does not <br />allow, Section 1135.01(A)(1). <br />Proposed second story garage addition with living space <br />2. A 298 sq. ft. variance for area of private garage; code permits 750 sq. ft., applicant shows <br />1048 sq. ft., Section 1135.02(B)(1)(a). <br />Proposed two story detached garage: 1048 sq. ft. <br />First floor: 524 sq. ft. <br />Second floor: 524 sq. ft. <br />Lot size: 19,159 sq. ft. (44 acre) <br />3. A 5 ft. 5 in. variance for height of a garage: code permits 15 ft., applicant shows 20 ft. 5 <br />in. Section 1135.02(B)(1)(b) <br />Mr. Weese speaking on behalf of his client expressing the necessity of the variances; stating that <br />Mr. Leaf -Clark has a large extended elderly family and plans for this second story garage <br />addition to house his elderly mother and the main house to use as a vacation house for himself as <br />well as housing for family that has deteriorating health. <br />Ms. Seeley asked if they could add on to the home instead of the garage; expressing concerns <br />regarding future situations of new owners using the addition for Air B&B and long-term rentals. <br />It was also asked if there was any consideration for expanding the footprint of the original home, <br />Mr. Weese replied that it was recommended, and the option was explored; however, the <br />homeowner preferred this option to house his elderly mother allowing her to remain independent. <br />Director Upton explained that these types of cases are not favorable and the planning staff is not <br />in the position to recommend approval. He also stated that the first variance looks to be a "use" <br />variance and requested clarification from the applicant. <br />
