He stated there are many businesses that are 30,000sgft or more. <br /> One shopping center is considered on complex. Mr., Anderson stated that it simply made It a <br /> conditional use which could ultimately be approved. Mr. Patton asked if they ended up passing <br /> this, how many businesses would be in violation. Director Upton replied they would be pre- <br /> existing non-conforming use, in other words "grandfathered in". Passing this would not affect any <br /> existing establishments so long as they continue to operate and do not cease to operate for over a <br /> year. Mr. Anderson pointed out that passing this would not allow for these businesses to operate <br /> in the city. They would have to be granted a conditional use to operate in the city. Director Upton <br /> replied that anyone has the right to due process and can appeal to BZBA for relief, so this is not <br /> and end all be all. Mr. O'Malley agreed and stated the condition would be imposed and subject to <br /> a variance review. <br /> Mr. Burns expressed his concern of the method of measuring lot line to lot line instead of building <br /> to building. He shared that he believed the 2500ft was too restrictive. Mr. Olivos agreed with Mr. <br /> Burns regarding measuring, Mr. Patton expressed considering the concerns and door to door <br /> measuring as well as amending the 2500ft to a lesser amount. Director Upton explained that lot <br /> line to lot line is easier to measure, and asking the applicant to survey a door to door measurement <br /> would be a burden. He agreed to decreasing the measurement to 1500ft. He also explained that the <br /> point and goal was to keep these establishments away from children. <br /> Mr. Anderson moved, seconded by Mr. Patton, to approve this 2023-18; Amend Section <br /> 1118.13 Conditional Use Regulations with an amendment to 1500ft and measuring from <br /> building to building. Motion passed 3-0. <br /> ADJOURNMENT <br /> Mr.Anderson moved,seconded by Mr. Olivos,to excuse the absence of Ms. Hemann,motion <br /> passed 3-0. <br /> With no further business, the meeting adjourned at 7:40 p.m. <br /> 2 F <br />
