Ms. Seeley offered that he has been complying with <br />the City's orders to stop work and to apply for permits. and he is taking all of the right steps to <br />follow the code in the City. including for future projects he is planning like his garage and <br />driveway. Mr. Upton expressed his approval for this case. Mr. Mackey asked City Staff if there <br />has been any progress at making amendments to the code to clarify better these variance requests <br />that have been increasing over time. Mr. Upton stated that there were several pieces of code that <br />are being worked on the define things for better clarification among other things that will be <br />going to Council. <br />Mr. Rahm made a motion; seconded by Mr. Kovach: to approve'23-24672; Odeh Odeh; 3550 <br />Clague Road. <br />Board members entered into their discussion led by Ms. Patton. She stated she felt the applicant <br />was making a number of improvements and that those improvements aligned with the character <br />of the neighborhood. She also stated that she was pleased to hear that the applicant was working <br />with the City to ensure he is taking the proper steps. Mr. Kovach agreed with Ms. Patton. Mr. <br />Rahm. Mr. Mackey and Mr. Papotto also agreed. <br />Motion Passes: -0 <br />COMMERCIAL APPEALS AND REQUESTS <br />23-24427; Valvoline; 21866 Lorain Road <br />Representative(s): Kelly Schwieterman 260 Sycamore Creek Drive Springboro. Ohio 4066 <br />Director Upton introduced the case as a request for a side set -back. He explained they were <br />doing some improvements at the site including a nice landscaping upgrade which included a <br />retaining wall. That retaining wall would encroach in the side set -back. He expressed his support <br />for this application. <br />Ms. Schwieterman explained she was part of the Civil Engineer and Architect Team for <br />Valvoline. She explained that Valvoline looks at site safety and operational improvements and <br />this site was chosen for an improvement. She stated they were adding additional parking spaces <br />and queuing. In doing this she explained that they were in need of more pavement and the site <br />has a narrow width. so that required the retaining wall. Ms. Patton asked the applicant if there <br />was no other way to obtain this without the variance due to the lack of space and narrow lot. Ms. <br />Schwieterman explained that the retaining wall was sitting on the property line and there would <br />be no way to achieve what they intended to do without the variance. Mr. Mackey asked a <br />question regarding the additional parking lot. specifically if there was a plan for drainage. Ms. <br />Schwieterman replied that all drainage would stay on the property and would not go into <br />neighboring properties. <br />Mr. Kovach made a motion. seconded by Ms. Patton; to approve 23-24427; Valvoline: 24866 <br />Lorain Road. <br />
