Motion Passed: 3-0 <br />COMMERCIAL APPEALS AND REQUESTS <br />170-2024; The Kingston; 4912 Grace Rd. <br />Mr. Kovach motioned to table 170-2024; The Kingston; 4912 Grace Rd. to the next meeting; <br />seconded by Ms. Patton. <br />Motion Passed: 3-'0 <br />174-2024; Walmart; 24801 Brookpark Rd. <br />Representative: Jordan Hexom <br />The applicant requested a variance of 79.17 feet for a building setback, as the code permits a <br />100 -foot setback. The proposal involved installing two 625 -kilowatt backup generators for <br />Walmart to provide power during outages. Due to the store's layout, extensive utility lines, and <br />the location of the electrical room, this spot was determined to be the most cost=effective and <br />practical. The building department,lhad no comments, but the director raised concerns about the <br />screening of the generators.. While the code didn't mandate specific screening for such structures, <br />the director suggested additional plantings 6� better -quality screening to minimize visual impact, <br />particularly for a nearby multifamily building. <br />The applicant clarified that the electrical room is located near the south end of the building, <br />around the existing transformer, and the generators would be placed nearby. When asked about <br />potential conflicts with gas meters or venting requirements, the applicant confirmed that no <br />issues were identified with the current setup. The location of the gas meter was not immediately <br />clear but could be verified. The applicant explained that the generators were new, not replacing <br />any existing ones, and the choice of location was determined to be the most cost-effective, given <br />the layout of the property. Alternative locations on the property would be less ideal due to space <br />constraints, particularly near the loading bays, which had specific truck turnaround requirements. <br />The applicant explained that the increased cost of conduit and electrical wiring would make <br />alternative generator locations unfeasible due to voltage loss over longer distances. The <br />requested 20 -foot variance applies to the setback from the right-of-way line along Brook Park. It <br />was confirmed that the setback requirements to the east property line, which borders the condos, <br />were met, with a 100 -foot distance from the generator to the street right -of way. However, the <br />exact distance from the generator to the east property line was not provided but appeared to be <br />less than 100 feet. The applicant also addressed concerns about the noise levels of the generators, <br />stating that they could check the decibel level and clarified that two generators were necessary to <br />power the entire store. The generators could alternate or adjust their RPMs depending on the <br />load. Additionally, there were no known air intakes near the back wall of the building, where the <br />generators would be placed, to avoid intake of exhaust fumes. <br />2 <br />
