The Board reviewed a request for a front porch addition requiring two variances: one to enlarge a <br /> nonconforming dwelling with an existing front setback of approximately 46 feet 6 inches where <br /> 50 feet is required, and another for a 10-foot front yard setback variance to allow a setback of 40 <br /> feet. The applicant explained that the porch would provide accessibility and outdoor space for a <br /> family member with cerebral palsy and would not extend significantly closer to the street. Staff <br /> noted the nonconformity was created when Steams Road was widened, reducing the front yard <br /> depth through no fault of the current or prior owners. The Board discussed that the hardship <br /> resulted from the state's right-of-way acquisition and confirmed that the matter was limited to <br /> zoning compliance,with building code review to follow if approved. <br /> Mr. Ammons made a motion to approve 306-2025; Mercedes Lux; 5854 Stearns Rd.; seconded <br /> by Ms. Galateanu. <br /> Motion Passed: 3-0 <br /> 308-2025; Anthony Adipietro; 23356 Olmsted Dr. <br /> The Board reviewed a request for two variances related to a detached garage: a five-foot variance <br /> from the required ten-foot rear setback and a two-foot variance from the required five-foot side <br /> setback. The applicant explained that the proposed 20-by-20-foot garage would replace an <br /> existing, slightly larger structure and that the side lot line was incorrectly shown on the original <br /> plan due to a fence encroachment.Upon clarification,the side setback appeared to meet code, <br /> leaving only the rear variance necessary. <br /> An adjoining property owner raised an ongoing adverse possession claim affecting the shared <br /> boundary line. Because of this unresolved legal matter and the applicant's need to find a new <br /> contractor,the applicant requested that the variance application be tabled. The Board agreed, <br /> voting to table the case without a specific return date until the boundary and ownership issues <br /> were settled. <br /> Mr. Ammons made a motion to table; 308-2025;Anthony Adipietro; 23356 Olmsted Dr.; <br /> seconded by Ms. Galateanu. <br /> Motion passed: 3-0 <br /> 312-2025; Adlai Perry; 3431 Columbia Rd. <br /> The Board reviewed a request for a variance to allow a storage shed to be located two feet from <br /> the rear lot line,where five feet is required. The proposed shed measured eight by fourteen feet <br /> and was intended to free up space in the attached garage. The applicant explained that due to the <br /> unique placement of the house and garage, options for a compliant shed location were extremely <br /> limited and that shifting it to meet code would block access to the backyard and reduce safety. <br /> Staff clarified that the original request referenced a side lot line but was amended to the rear lot <br /> line, and confirmed the lot's configuration created practical difficulty in meeting setback <br /> 2 <br />
