?? . <br />I ? <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - DECEMBER 2, 1987 <br />Chairman Remmel called the meeting to order at 7:40 p.m. <br />Present: R. Bugala, B. Grace, J. Helon, and C. Remmel. <br />Absent: R. Gomersall <br />Also Present: Law Director M. Gareau, Building Commissioner D. Conway, and <br />Clerk of Commissions B. Oring. <br />In the minutes of November llth, Chairman Remmel stated that the sentence <br />on Page 3, the 20th line, which reads, "Mr. Grace believes that since the <br />philosophy of the city has been to eliminate pole signs, it is up to the <br />Board to uphold this philosphy so that North Olmsted does not become a <br />truck stop" be stricken from the minutes. He further req_uested th at this eorrection be issued to-this Board and to the Planning Gommission. Mr. Grace <br />objected'since he hadmade the statement. C. Remmel moved that the amend'edi <br />minutes of November 11, 1987 be approved-. Motion failed for lack of a <br />second. Minutes are neither approved nor disapproved. <br />CoTumbia Village Apartments, Pfiase III, (Realtek Industries), loeated to rear <br />of lots on the north side of L'orain Road between Columbia and Root Roads. <br />Request for variance (.1123.12). Request variance to construct 3 stozv <br />apartment. Violation of Ord. 97-93, Section 1149.03c&d!. Also request <br />_-= variance to have less than tfie 50 foot buffer adjaeent to residential pro- <br />pe•rty (10 feet at closest point). Violation of Ord. 87-93',, Section 1149.05d. <br />(Continued from meeting of November 11, 1987). <br />Chairman Remmel called D. King, attorne_y for Realtek Industires, Law Director <br />M. Gareau, and Mr. Rosenthal, President of the Hyde Park Condominium Associa-. <br />tion, before the Board and administered the'oath. Chairman Remmel read a <br />letter from John B. Parent for his mother, Mary Parent, to the Hyde Park <br />Condominium Owners Association which reads as follows: "November 29, 1987/ <br />Hyde Park Condominium Owners Association/ Subject: Columbia Village, Phase III/ <br />Re: November 23, 1987 Meeting/ This letter is to advise.you and the members <br />of the North Olmsted Zoning And Planning Commission, that I am adamantly op,posed to the zoning variance being requested bv Consolidated Management, <br />Realtek Industries, (the Developer)./ Also, Mike Skenzich, who represented <br />the owner of suite 4304-3 Hyde Park for sale to Mary Parent in July 1986, <br />stated that the vacant land would one day be used to build additional town- <br />homes. In fact, he cited that the footers €or them had already been poured. <br />When I cited this incidence at the November 23 meeting, four or five additional <br />owners present, indicated Mr. Skenzich had made the same misrepresentation to <br />them./ Accordingly, fi request the city of North Olmsted deny the zoning <br />changes and/or variances being requested./ Sincerely, /John B. Mr. Remmsl also presented a petition sigried by 42 members <br />of the Hyde Park Condominium Association objecting to the request of Realtek <br />Industries and requested that both be made part of the file. Chairman Remmel <br />advised that the Board has nb ,jurisdiction over the individual condominium <br />agreements and can neither enforce nor approve them, pointing out this would <br />be a civil matter. Mr. Rosenthal reguested that Mr. Parent's comments be <br />considered, even though they cannot be used as evidence. At this point
