t r <br />CITY OF NORTH OLM5IED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES-FEBRUARY 23, 1989 <br />I. ROLL CALL: <br />Vice Chairman Schulz called the meeting to order at 7:33 p,m. <br />Present: J. Konold, B. Schulz, and D. Spoerke <br />Absent: J. Kazak and R. Burk <br />Also Present: Building Commissioner Conway and Clerk of Commissions Oring. <br />II. REVIETd AND CORRECTION OF MINUTES: <br />D. Spoerke moved to accept the minutes of January 26, 1989 as read, seconded <br />by J. Konold, and unanimously approve?. <br />III. COMMUNICATIONS: <br />A cony of letters sent to Aloha Construction from the Building Commissioner <br />advising that they were no longer registered with the city since their check <br />had been returned. Mr. Conway explained that the check had been returned <br />because it had expired and that the contractor did come in to pay for his <br />registration, however he left without paying after he was told that the home- <br />owner had taken out a homeowners permit. <br />IV. HEARINGS: <br />1) Walter H. Ahlers, 4352 Columbia Road <br />Request variance to have a ceiling height of less than 7 foot 6 inches <br />to complete dormer addition (10 inches on the south side and 6 inches on <br />north side), Violation of Section R207 of the CABO One and Tao Family <br />Dwelling Code. <br />Mre Spoerke read the request, Mr. Ahlers was advised that there were only <br />three members present and that it takes three affirmative votes to approve <br />a request and if this request is not approved the only appeal would be <br />through the Court of Common Pleas. Mr. Ahlers decided to proceed as <br />scheduled and was administered the oath by Vice Chairman Schulz. P1r. Ahlers <br />presented pictures of the addition and members studied plans. Building <br />Commissioner Conway advised that the dimensions shown also encompasses the <br />roof joists, and that the height is 80 and 84 inches, not the 7 foot 8 inches <br />as shown. Mr. Schulz and Mr. Spoerke had visited the site. A1r. Conway <br />advised that since the work had Ueen started without a permit, he issued a <br />permit for a storage area only which he would have had the right to do <br />without approval, and gave him permission to board the exterior because of <br />weather conditions. Mre Ahlers explained that the roofing materal would <br />be a Weather Shield (rubber roofing) because the pitch is very shallow. <br />Mr. Conway advised that this addition will be used as an in-law suite. <br />Mr. Ahlers explained that his parents have a home in Canada and stay with <br />him in the winter and this area is the kitchen, Mr, Schulz stated that a <br />fire broke out in the insulation tha.t was being installed while he was on <br />the site. Mr. Ahlers stated that he was doing the work himself and his <br />brother was installing the insulation. Mre Conway stated that there were <br />different stories on this, but that does not have an effect on this appeal. <br />Mr. Schulz is concerned because the State Code is a mininum codeand=this- is
