r- <br />CITY OF NORTH OLMSTID <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES-SEPTIlHBER 26, 1991 <br />I. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:36 p.m. <br />Present: J. Kazak, D. Spoerke, and R. Burk <br />Absent: T. Mulloy and B. Schulz. ? <br />Also Present: Building Commissioner Conway and Substitute Clerk of <br />Commissions Ldingenfeld. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />Minutes of August 22, 1991 were corrected on page two should read D. Spoerke. <br />J. Kazak moved to approve the minutes of August 22, 1991 as corrected, <br />seconded by D. Spoerke, and imanimously approved. <br />III. COMMUNICATIONS: <br />No items. <br />IV. HEAItINGS : <br />James A Miller, property located between 5938 and 5918 Porter Road. <br />Request permission to construct dwelling an permanent parcel rnnnber 235-14-59, <br />sublot 300, ("B" District,, minimum lot frontage 70 feet). Hearing required by <br />Ord. 2806 (any house being built on a lot with a 50 foot front width or less <br />requires the approval of the Board of Building Code Appealse <br />Chairman Burk administered the oath to Mr. Miller, owner and builder of the <br />property, Councilman Nashar, Mr. & Mrs. Eichelberger, Mrs. Mitchell, Mr. and <br />Mrs. Hosier, Mrs. Knight, Mr. and Mrs. Gravenstreter. Mr. Miller stated that <br />the request was to construct a 24 foot wide home on a 40 by 150 foot wide lot <br />and that the house meets the minimum square foot area required. He maintained <br />that the house would increase the value of the adjacent properties and would <br />be a nice home for the neighborhood. It was clarified that there were 40, 50, <br />60, and 70 foot wide lots on the street. Councilman Nashar stated that the <br />majority (80 to 90%) of the lots are over 60 foot wide. Building Commissioner <br />Conway advised the adjacent residents that this Board is not a Board of Zoning <br />Appeals, and will mainly address the impact of the proposal on adjoining <br />property as far as drainage and grading. Neighbors maintained that they do <br />have drainage problems on Porter Road. Mr. Kazak responded that this would <br />pertain to ground drainage on the lot itself, and it is a level lot. In <br />response to the neighbors question, Mr. Miller advised that there would be no <br />basement. The neighbors maintain that the other basementless houses on Porter <br />Road have problems with floors rotting out from water problems. Mr. Nashar <br />stated that this house would have one 5 foot side yard and one 11 foot side <br />yard which would not conform to the other properties on the street. He also <br />stated that in 1989 this Board denied approval to build on this property. Mr. <br />Kazak did not think there would be problems with drainage on this lot and <br />explained that the Engineering Department would have to make him contain all <br />the water on his property. Neighbors are also concerned about fire since the <br />houses will be so close together. Mr. Kazak stated that there are other houses <br />on the street on 40 foot lots. The residents also ma.intain that the City sent <br />letter out regarding these basementless homes since they are deteriorating so <br />badly. Mr. Conway advised that the problems with the basementless houses had <br />not been with the design, it was where the home owners closed up the venting <br />1
