.?r <br />.:.. _ ;. <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-FEBRUARY 13, 1991 <br />Chairman Gomersall called the meeting to order at 7:35 p.m. <br />Present: R. Gomersall, E. Gallagner,B. Grace, J. Maloney, and T. Restifo <br />Also Present: Law Director Gareau, Chief Building Inspector Sanker, and <br />Clerk of Commissions Oring. <br />1) Shell Oil Com an 23385 Lorain Road. <br />Request for variance (1123.12). Request variances for width of driveways (12, <br />7, and 14 foot variances for width exceeding the maximiun allowed) to rebuild <br />existing gas station; also request variance for drive which is only 33 feet <br />rather than 60 feet from nearest intersecting street line. Violations of Ord. <br />87-93, Section 1161.09 (b) and (a). Request 16 foot front setback variance <br />and a 25 foot side set back variance for canopy. Violation of Ord. 87-93, <br />Section 1139.04-(a & b). Also request a variance for exceeding 50 square feet <br />(one side of pole sign). Violation of Ord. 87-93, Section 1163.06-(f)4. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. King, attorney Mr. Coburn, Mr. Moore, Mr. Scheel, <br />representatives of Shell Oil and Mr. Starcher, operator of this station. Mr. <br />King advised that they are requesting only a 4 square foot variance for the <br />sign and will be removing the reader board. He reviewed the previous <br />stipulations of Planning Conunission: that some of the parking south of the food <br />mart on the adjoining property be removed; that the "exit only" sign be changed <br />so that is is more noticeable; and the traffic flow on the property be more <br />clearly identified. Mr. Gomersall stated that there was too much building for <br />this lot. Mr.. Coburn presented a revised plan and responded that they have <br />been tmable to obtain any additional land from the owner of the adjacent <br />shoppi.ng center and explained that he food mart was necessary to keep their <br />dealers competitive. Mr. Maloney is concerned about employee parking, where the <br />vendors would park, and pointed out that many customers park in front of the <br />building. The representatives responded that there are 4 parking spaces on <br />the lot; that since 90% of their customers come in for gas, most leave their <br />cars at the pump; that they have spread the structures on the site to improve <br />maneuverability on the property; that most deliveries only took a short period <br />of time, that the existing utility building was going to be removed. In <br />reference to obtaining more property, Mr. King advised that the owners have <br />leased the shopping center to the Kroger Company and they cannot get more <br />property. Law Director Gareau is concerned about over clevelopment since this <br />improvement should increase business. He pointed out there could be a stacking <br />problem on Lorain Road. Mr. Aloore stated that when this issue was addressed <br />when the station was built and that this is about the best traffic pa.ttern <br />available. Mr. Coburn pointed out that this driveway was also used for their <br />tanker trucks and they would never be allowed to drive these over the adjacent <br />lot. Mr. Starcher stated that many cars used the exit onto the adjacent <br />property ar:d used their drives onto the street. It was clarified that this <br />interior exit was not mentioned in the lease, and that there was no recorded <br />easement for it, but had been their since the station was built.
