<br />CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES-AUGUST 26, 1993 <br />I. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:35 p.m. <br />Present: J. Ka.zak, D. Spoerke, and R. Burk. <br />Absent: W. Piar. <br />Also Present: Building Commissioner Conway and Clerk of Commissions Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />D. Spoerke moved to approve the iiu_nutes of July 29, 1993, seconded by J. <br />Kazak, and unanimously approved. III. COMMUNICATIONS: <br /> <br />Memo from the mayor requesting information about Mr. Schulz which will be included in the proclamation. The clerk will check with Mr. Gundy to see if he <br />would ha.ve any information. <br />Letter from Richard M. and Catherine A. Scott pertaining to the Simmons <br />Construction Company proposal. <br />Memo from Building Commissioner Conway will be discussed tmder Old Business. <br />IV. HEARINGS: <br />1) Siirunons Construction Company, 29650 Broxbourne Road (vacant lot east of 29730). <br />Request permission to construct dwelling on permanent parcel rnunber 233-22-1, <br />sublot 146, ("C" District, minimun lot frontage.60 feet). Hearing required by <br />Ord. 2806 (any house being built on a lot . with a 50 foot front width or less <br />requires the approval of the Board of Building Code Appeals.) <br />Chairman Burk read the letter from Mr. and Mrs. Scott (see attached) objecting <br />to the aesthetics of the proposal and drainage. Chairman Burk administered the <br />oath to neighbors, Mr. and Mrsa Plez, J. Walters, Mrs. B. Mancuso, Ms. Knopf, <br />and A. Muzie, and Mr. Simmons, Jr., contractor, and his father, Mr. Simmons, <br />Sr. Mrm Walters asked what the drainage problems were that were mentioned in <br />the letter. Mr. Burk re-read item 4 of the letter. Mr. Walters agreed that <br />these problems had been in the area since 1976. P1r. Plez agreed with the letter <br />since there are two vacant 1ots, eventually there will be 2 small, tall, houses <br />squeezed on two lots between the adjacent 90 foot wide lots. Mr. Simmons, <br />senior, noted that there were other 45 foot lots on the street, but Mr. Plez <br />maintained that the lots an this side of the street were wider and most of the <br />houses were lowo Mr. Sinunons, Jr. clarified that the block building on the lot <br />would be sided and left with the house. Building Commissioner Conway advised <br />that the former owner will be going to court August 31 for failure to remove <br />the structure, but since he no longer owns the property, probably no action can <br />be taken against him. He clarified that, in order to keep this structure a <br />variance would be needed for the side yard set.back and depending on the use of <br />this building, a variance for area of the structure might be required. Since <br />the codes stated that there can be no accessory structures on an undeveloped <br />lot, this building was ordered to be removed after the house was razed. The <br />building is 24 by 24 feet, but its use must be established before a variance <br />could be determined. The code permits 750 square foot of garage area (there is <br />an attached garage on the house), but if it will be used to house animals the <br />requirements would be different.
