9 • <br />! <br />CITY OF NORTH OUISTID <br />BOARD OF ZOlVING APPEALS <br />rINUrES--aPxzL 14, 1993 <br />Vice Chairman Maloney called the meeting to order at 7:35 p.m. <br />Present: B. Grace, T. Koberna, W. Purper, and J. Maloney. <br />Absent: R. Gomersall. <br />B. Grace moved to approve the Ttinutes of March 3, 1993, seconded by T. Koberna <br />and unanimously approved. <br />Vice-Chairman Alaloney advised those present that 3 affirmative votes were <br />required for approval, and each case will be judged bn the physical situa.tion <br />peculiar to itself. No judgement should be considered to be general policy <br />judgement effecting properties or like situations elsewhere. <br />1. Berni-e and Kathy Golden, 23380 Sharon Drive. <br />Request for variance (1123.12). Request 372 square foot variance to install pool <br />and deck which exceeds the maximnn 20% rear yard coverage allowed for accessory <br />structures. Also request 2 foot rear setback variance from required 10 foot set <br />back between deck (around pool) and rear property line. Violations of Ord. <br />90-125, Sections 1135.02(d)2 and 1135.02(d)4. <br />Vice-Chairman Maloney called all interested parties before the Board. The oath <br />was administered to Mre Golden who advised that the deck will now only be 3 feet <br />deep, not 4 foot as originally stated. The members had no questions. B. Grace <br />moved to grant the 372 square foot variance to install pool and deck which exceed <br />the maxiimAn 20% rear yard coverage allowed for accessory structures. Also grant a <br />2 foot rear setback variance from required 10 foot set back between deck (around <br />Pool) and rear property line, seconded by W. Purper, and unanimously approved. <br />After the motion Building Commissioner Conway advised that by reducing the deck 1 <br />foot in diameter would also reduce the setback variance to 1 foot. B. Grace moved <br />to amend the motion to change the 2 foot rear setback variance to a 1 foot rear <br />setback variance, seconded by W. Purper, and unanimously approved. Variances <br />granted. <br />2. Syed Abbas, 6550 Barton Road. <br />Request for variance (1123.12). Request variance to delay constructing a garage <br />for one year (former garage was demolished without a permit). Violation of Ord. <br />90-125, Section 1161.08(a)l. <br />Vice Chairman Maloney called all interested parties before the Board. The oath <br />was administered to Mr. Abbas, who maintained that he did have a permit to <br />demolish the original garagee Building Commissioner Conway clarified that the <br />permit was taken out after'the garage had been taken down. Mr. Abbas stated that <br />the garage was in such bad "shape he was concerned that someone anight get hurt. He <br />did intend to build a new garage, but due to the expense of refurbishing the <br />house there are no funds left for the garage. The house is for sale and it is <br />stipulated in the contract that the buyer must build a garage per city ordinance. <br />Mr. Conway is concerned because a buyer usually puts all his funds into a down <br />payment, and he might not have the funds to build a garage. He suggested that the <br />variance might be granted for a period of time if the house is rented, or until <br />there is a transfer of title if the house is sold. He stated that the city would <br />not luiow when a property was sold for months after the deal was completed, and he <br />would also lilce a definite date set for the construction. It was suggested that a <br />six month period would be satisfactory. Mr. Abbas would prefer more time. The <br />1
