<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEAI,S <br />MIlN-UTES-NOVEMBER 1, 1995 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: T. Koberna, J. 1Vlaloney, W. I'urper, and R. Gomersall. <br />Ms. Boyle arrived later. <br />Also Present: Law Director Gareau, Building Commissioner Conway, Assistant Building <br />Commissioner Rymarczyk, and Clerk of Commissions Oring. <br />W. Purper moved to approve the minutes of August 31, 1995 meeting and the October 5, 1995 ineeting <br />as written, seconded by J. Maloney, and unavimously approved. <br />Chairmau Gomersall advised that each case would be judged on the physical situation peculiar to itsel? <br />so that in no way is a judgment rendered considered to be a general policy judgmeut affecting properties <br />and like situations elsewhere. He explained that it would take 3 a?'irinative votes to approve a request. <br />1. Heleu Martin, 25234 Sunset Oval. <br />Request for variance (1123.12). Request 5 foot side yard variance to keep existing carport which is <br />attached to garage. Violation of Ord. 90-125, Section 1135.07. <br />Chaiiman Gomersall called all interested parties before the board. The oath was admivistered to <br />Mrs. Martin and her son-in-law, Mr. Alexander, who explained that the structure had been up for over <br />20 years and has been maintained. Mrs. Martin's late husband did file for a permit, but the city had no <br />record of it in the files. Building Commissioner Conway advised that there had been a complaint on the <br />structure, but because of some personal issues the Building Department delayed bringing it before the <br />board. But they are presenting it now so that if a neighbor had a complaint, it could be brouglat up. There <br />were no neighbors present. The members had no problem with the request. Mr. Conway suggested that, <br />if a variance is granted, it should apply only to the present home ovvuer, so that the structure must be <br />removed when the property transfers. W. Purper moved to grant the request for Helen Martin, 25234 <br />Suuset Oval for a 5 foot side yard variance to keep an existing carport which is attached to the garage <br />with the stipulation that this is to apply only to the current property owners, so if the property ever <br />chauges hands the attaclvnent to the garage is to be removed. Violation of Ord. 90-125, Section <br />1135.07. The inotion was seconded by J. 1Vlaloney. Roll call on motiou: Puiper, Maloney, Kobema, and <br />Gomersall, yes. Ms. Boyle, abstained. Variance granted. <br />2. Michael Isabella, 4199 Clague Road. - <br />Request for variance (1123.12). Request 210 square foot area variance to replace existing detached <br />garage. Violation of Ord. 90-125, Section 1135.02(c)(1). <br />Chairman Gomersall called all interested parties before the board. The oath was acisnuustered to Mr. and <br />Mrs. Isabella and Mr. Popp, a neighbor who lives next door, Mr. Isabella clarified that the garage-would <br />be 24 by 40. The Isabellas explained that Mrs. Isabella runs a day care center out of her home and they <br />need storage room for her equipment, for tools for his job and for lawn equipment. Mr. Popp believed <br />that the size of the garage is excessive and would be an eyesore from lus property. Mr. Koberua and Nlr. <br />Gomersall agreed that the garage was too large and suggested that it be reduced to 24 by 25 feet. Nfr. <br />Isabella stated that would be too small. The members discussed various options. Building Coinmissioner <br />Conway advised that he could have a 24 by 31 foot garage, since he is pennitted 750 square foot for <br />garage area by code.
