<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINLJTES-JANUARY 31, 1996 <br />Chairman Gomersall called the meeting to order at 7:40 p.m. <br />Present: M. Boyle, W. Purper, J. Maloney, and R. Gomersall <br />Absent: T. Koberna, <br />Also Present: Law Director Gareau, Bu.ilding Commissioner Conway, and Clerk of Commissions <br />Oring. <br />Chairmau Gomersall advised that each case would be judged on the physical situation peculiar to itsel? <br />so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. He explained that it would take three affirmative votes to <br />approve a request. W. Purper moved to accept the minutes of December 6, 1995 as written, seconded by J. Maloney, and <br />unanimously approved. <br />4. J. & E. Bucsanvi, 25179 Gessner Road. <br />Request for variance (1123.12). Request 3 foot side setback variance for shed (already installed). <br />Violation of Ord. 90-125, Section 1135.02. . <br />Chairmau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Bucsanyi and a neighbor, Mrs. Braskich. Mr. Bucsanyi explained that he cannot use the back yard most <br />of the year because it is so wet. He, needed a shed for storage. Mr. Gomersall explaiued that the <br />variance had nothing to do with the water problems, the shed was too close to the side line. He <br />constructed a deck because of the wet backyard, and he has a concrete sidewalk next to it so it would <br />be difficult to move the shed. Mrs. Braskich, whose back yard abuts his side property, is concerned <br />that if he stores flammable materiaLs in the sheds, it could cause a fire and her wooden fence could <br />burn. She is also concemed because children climb on the roofs of the sheds. Mr. Bucsanyi explained <br />that he did not store flammable materials at home, he worked for a company. Mrs. Braskich noted that <br />lawn mowers used gas. Mr. Bucsanyi promised to keep the lawn mower in the garage. She again <br />mentioned the children climbing on the sheds and falling onto her fence, and she would be liable. She <br />believed that the shed being so close would endanger her property. Mr. Bucsanyi agreed that he could <br />move the shed, but if he moved it 3 feet over it would be right next to his deck. It was suggested that <br />the shed be moved over 1.5 feet from the property line. Mr. Bucsanyi agreed. Ms. Boyle pointed out <br />that the shed could not be moved in the winter. Mrs. Braskich believed that the codes should be <br />enforced and wondered if North Olmsted would share the expense if her fence burned. Ms. Boyle did <br />not believe that 1.5 feet would make a difference if.there were a fire. W. Purper moved to grant to J. <br />& E. Bucsanyi, 25179 Gessner Road, a 1.5 foot side setback variance for shed (akeady installed). <br />This modified variance has been mutually agreed on by the applicant and is granted with the condition <br />that the shed should be moved prior to July 1, 1996. Violation of Ord. 90-125, Section 1135.02. The <br />motion was seconded by R. Gomersall, and unanimously approved. Variance granted. <br />1. McDonald's, 24801 Brookpark Rd. <br />Request for variance (1123.12) Request variance to have two permanent logo window signs. Violation <br />of Ord. 90-125, Section 1163.12(G). Please note Wal Mart and McDonald's building signs exceed the <br />square footage of signage allowed by code. <br />1
