? <br />? ` . <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MIlNUTES - DECEMBER 11, 1996 <br />AMENDED <br />Chairinan Gomersall called the meeting to order at 7:30 p.m. <br />Present: M. Boyle, R Gomersall, W. Purper, and J. Maloney. <br />Absent: T. Koberna Also Present: Law Director Gareau,,Assistant Building Commissioner Rymarczyk, and Assistant Clerk of <br />Commissions Cornish. <br />J. Maloney moved to accept the minutes ofNovember 7, 1996; as written, seconded by W. Purper. <br />Roll call on motion Maloney, Purper, and Gomersall, yes; Boyle abstained. <br />Chairmau Gomersall advised that each case would be judged on the physical situation peculiar to itselt so <br />that in no, way is a judgment rendered considered to be a general policy judgment affecting properties and . <br />like situations elsewhere. <br />1. Custom Tint (Harmon Glass) 25770 Lorain Road. <br />Request for variance (1123.12). <br />Request 45 square foot variance for excess sign area for a business unit; <br />request variance to install individual tenant sign on existing non-conforming pylon sign; <br />request variance to have phone number on sign; and request 2 foot, 3.5 inch variance for <br />height of pylon sign. <br />Violation of Ord. 90-125, Sections 1163.12 (a) &(h); 1163.03(c); and.1163.12(b). <br />Note: (1) Both signs have been installed without permits and Custom Tint is sharing building and <br />office with Harmon Glass. <br />(2) Non-conforming pylon sign must be removed by January 1, 1998. <br />Chairmau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Chechowski, Mr. Hansen and Mr. Coawson. It was noted this is the same variance requested in <br />October. Mr. Hansen clarified the request is for a temporary variance as he understood the sign is <br />to be removed by January 1, 1998. Chairman Gomersall questioned if there has been any attempt to <br />contact Mr. Rini as the board had requested at the October meeting. Mr. Hansen explained he did <br />contact Mr. Rini, and Mr. Rini' stated he had discussed this with Mr. Gareau. W. Gareau clariified <br />he was never contacted by Mr. Rini regarding the sign for Custom Tint. Mr. Hansen explained last <br />week he had attempted to contact W. .Gareau, but due to scheduling conflicts was unable. He <br />continued, yesterday he was informed that Mr. Rini had contacted Mr. Gareau and will work <br />something out. Mr. Gomersall believed this sigu is a hazard, as a strong wind could knock it over. <br />Mr. Purper.agreed as the boards requests at the October meeting were not addressed. Mr. Hansen <br />agreed to remove the telephone number if that would make the sign. acceptable and was willing to <br />comply with the ordinance in 1998. He did not, believe he should be punished for the landlords <br />failure to cooperate. Mr. Gomersall was unwilling to approve this sign as he.believed it is a hazard. <br />W. Hansen argued that he needed more time. Mr. Gomersall explained the next meeting is <br />February 5, 1997, and wondered if this can be amended by. that time. Mr. Hansen explained the <br />lease situation and was wisure if this could be completed 'm the time allotted. He. elaborated <br />landlord approval would be required and thus far the landlord has not cooperated. Mr. Gareau <br />wondered why there was no attempt to contact Mr. Rini- until last week. Mr. Hansen clarified that <br />he finally contacted Mr. Rini last week, as he had been trying for quite some time. Mr. Hansen did <br />,
