CITY OF NORTH OLMSTED <br />BOARD OF BUII,DING CODE APPEALS <br />MIlNUTES - MARCH 27, 1997 <br />1. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:50 P.M. <br />Present: R. Burk, J. Kazak, and D. Spoerke. <br />Absent: W. Piar and P. Engoglia. <br />Also Present: Assistant Building Commissioner Rymarczyk and Assistant Clerk of <br />Commissions Cornish. <br />II. IZEVIEW AND CORRECTIONS OF MINUTES: <br />J. Kazak motioned to approve the minutes of February 27, 1997, seconded by D. Spoerke aud <br />unauimously approved. <br />III. COMMUNICATIONS: <br />Chairman Burk noted a correspondence has been received from Larry Hamilton at 5581 Porter <br />Road regarding the hearing scheduled for tonight. The members have read this correspoudence. <br />N. HEARINGS: <br />1) Timberview Homes, P.P. #235-12-61, vacant lot located between 5581 and 5609 South Porter <br />Road. Request permission to construct house on a 40 foot lot. Heariug required by Section <br />1305.05(b) to ascertain that proposed construction does not affect drainage of suiface water or <br />waste into or over adjoining property or into any public street. Please uote: Eugineering <br />Department will review the site plan for drainage. Hearing by the board of zoning appeals will be <br />requu-ed. <br />Mr. Cuz-t Duulap, the builder, presented the proposal. Also present were: Councilman Nasher; <br />Mrs. Hamilton; Mis. Steiner; Ms. Graf; Ms. Costa; Mr. & Mrs. Miller; and Ms. Sclimidt. <br />Couucihnan Nasher explained there is an existing flooding problem on Porter Road and many of <br />the resideuts fear adding another home on Porter will only add to tlus problem. He noted, <br />although Mr. I3unlap's retention system will remove the water from his lot, tlus process will <br />ultunately causes uudo hardslup on the surrounding ueighbors that do not have a retention system. <br />Mi. Nasher advised two years ago the city replaced storm pipes and cleaned out some of the <br />ditches in an attempt to solve tlus flooding problem. Mr. Duvlap explained a back yard drain will <br />be installed and the water swailed either to the backyard drain or the front yard ditch. He believed <br />the flooding probleins elsewhere on South Porter should be addressed individually, as he is not <br />responsiUle for controlliug the water on other lots. The neighbors clarified the ditch is meant to <br />control the water, but it does not always work that way. Mr. Burk asked Mr. Dtuilap where the <br />back yard drain would einpty. Mr. Dunlap believed there is a problem with the ditches, however, <br />the water is controlled better by buildiug on the lot thau it would be if the lot remained vacaut. He <br />noted everyoue seeins to drain to this vacant lot. Mr. Kazak believed the city should address the <br />drainage problem in this area. Ms. Costa explained she has spent considerable amount of money <br />in an attempt to eliininate tlus flooding problem. She elaborated the water drains to the street, but <br />stops aud overflows. Mrs. Steiner explaiued, when her drainage. tile was redone, she was told <br />they must draui to the Uack rather than the frout. N1r. Burk questioned where the water drains in
