x <br />? <br />CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - SEPTEMBER 26, 1985 <br />I. ROLL CALL: <br />Chairman Kazak called the meeting to order at 7:36 p.m. <br />Present: R. Burk, J. Kazak, R. Puzzitiello, and B. Schulz <br />Absent: J. Patton <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The minutes of August 8, 1985 should reflect that the meeting of July 25th <br />was cancelled b.ecause:only Mr.:Schulz and the Secretary were present. R. <br />Burk moved to approve the Minutes of August 8, 1985 as corrected, seconded <br />by B. Schulz, and unanimously approved. <br />III. OLD BUSINESS: <br />Hear later in meeting. <br />IV. NEW BUSINESS: <br />C.M.H.E.C. Corp dba Curtis Mathes, 4579 Great Northern Blvd. <br />Request permission to install satellite dish earth station at 4579 Great <br />Northern Blvd. If structure is placed in rear yard as requi,red in Ord. <br />83-154, Section 1367.03. the applicant proposes the height to exceed the <br />maximum of 15' as required in Section 1367.06; or as an alternative a vari- <br />ance is re'quired to place satellite dish in sideyard contrary to Section <br />1367.02. <br />Chairman Kazak administered the oath to Mr. G. Peck, representing Curtis <br />Mathes, and neighbors, M. Turk, Mr. and Mrs. D. Lewin, and Mr. and Mrs. <br />Baker. Mr. Peck explained that since they are selling the satellite dishes <br />they are required by theirfranchise to have an installation at their store <br />so customers can see the unit and can see and hear the actual reception. <br />If the dish is located in the rear yard as required by Ordinance, it must <br />exceed the height of the building (will be 23' high); dish is 9'2" in dia- <br />meter. Neighbors objected to this height since dish will be visable from <br />their homes. One front yard location (B) is shown on plan at corner of <br />building, however, Mr. Peck suggested a third location which would be on <br />the northeast sid'e of the building, next to the chain like fence of the ad- <br />jacent Speedy Muffler (noted on plan as location C). This location is non- <br />conforming, but height would conform to the 15' maximum allowed. Neighbors <br />preferred this location. Since this would use one parking space, Mr. Schulz <br />is concerned that this would take required parking spaces below minimum. <br />He was also concerned that other electronic stores would be putting in <br />these earth stations. He also believes that the company should have <br />found a location where they could have put in the earth station without <br />requesting var.iances. Mr. Schulz moved to continue the Curtis Mathes <br />request until the next meeting pending clarification of the parking require <br />ments of the center in regard to Section 1367.03, seconded by R. Burk, and
