CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - OCTOBER 25, 1984 <br />1. ROLL CALL: <br />Chairman Schulz called the meeting to order at 7:30 p.m, <br />Present: R. Burk, J. Patton, R. Puzzitiello, and B. Schulz. <br />Absent: J. Kazak. <br />Also Present: Building Commissioner E. Gundy and Recording Secretary <br />B. Oring. <br />II. REVIEGT AND CORRECTION QF MINUTES: <br />The Minutes of August 27, 1984 were approved as submitted. <br />III. NEW BUSINESS: <br />1) Private Cable Distributing, Inc., 9217 Midwest Ave., Cleveland, OH <br />Request permission to install satellite dish earth station at Westbury <br />Apartments, 25252 Brookpark Rd., Structure to be located in side yard, <br />12' from property line. Violation of Ord. 83-154, Section 1367.02-A. <br />Also diameter of structure to be 16'5", Violation of Ord. 83-154, <br />Section 1367.06. 5' high screen planned. Violation of Ord. 83-154, <br />Section 1367.07. <br />Chairman Schulz requested that representatives of Private Cable Dis- <br />tributing stand before the Board. No representative was present. Mr. <br />J. Thomas of West Shore Cable T.V. was sworn in by Chairman Schulz. He <br />requested that the Board not grant the variance for the following rea= <br />sons: 1) residents of the apartment would not receive the City Hall <br />channel, the emergency over-ride system, local channels or local <br />public access channels; 2) residents would have no rate protection as <br />cable.subscribers do; 3) City would not receive any franchise fees. <br />Mr. Gil Richland of Great Northern Development Co. was swo.rn in. He <br />objected on the basis that this dish is only 12' feet from property line <br />and would be visible from the Great Northern Corporate Center and would <br />adversly affect their complex and also that 5' fence is not adequate <br />screening. Mr. Richland believes that an alternate location could be <br />found. Mr. Burk stated that a higher fence could interfer with re- <br />ception and that the earth station has to be on the south side of the <br />building for proper reception. It was also noted that Great Northern <br />owns77 property to the south and could possibly construct a building'up <br />to 20 stories which might also interferewith reception. J. Patton <br />moved to deny the request, seconded by J. Burk, and unanimously approved. <br />IV. OLD BUSINESS: <br />Chairman Schulz has been attending meetings of the Ad Hoc Committee of
