? <br />T- <br />CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - SEPTENIBER 29, 1983 <br />I. ROLL CALL: <br />Chairman Schulz called the meeting to order at 7:35 p.m. <br />Present: J. Kazak, J. Patton, and B. Schulz <br />R. Tallon arrived at 7:40 p.m. <br />Absent: R. Puzzitiello <br />Also Present: Building Commissioner E. Gundy and Recording Secretary <br />B. Oring <br />II. REVIEW AND CORRECTION OF MINUTES: <br />In the Minutes of August 25, 1983, Mr. Kazak should be shown as absent. <br />The Minutes were approved as corrected. <br />III. NEW BUSINESS: <br />1. Third Federal Savings and Loan, 26949 Lorain Rd. 7:30 p.m. <br />Appealing an order of_the Assistant Prosecutor Dan Ryan as <br />per letter dated June 27, 1983 (sidewalk violation citation). <br />Violation of Codified Ord. 1362.02 (a) (8). <br />W. J. Boukalik, attorney representing Third Federal, was sworn in <br />before the Board. He stated that he was not sure that his client <br />was in violation of the section cited (Section 1262.02 (a) (8). <br />The problem is not grade separation, cracking, or pitting. The <br />problem is standing water on the sidewalk caused by lack of curb, <br />causing water to run over curb and stand in the low par;tin the <br />center of the sidewalk. Unless curbs are installed, replacing <br />sidewalk and crowning it in the center will not permanently <br />solve problem. Water is coming off Lorain, not off their pro- <br />perty, and the continuing flow will wear away or undermine concrete. <br />His client is willing to replace sidewalk as prescribe, if curbs <br />are being replaced. They already have an estimate of approximately <br />$2,700. Lorain Road is in the process of being resurfaced by the <br />State and some curbs are, at present,_being replaced. If curb is <br />not going to be replaced, they want some other way to solve the <br />problem. The Engineering Department will have to check to see if <br />State is going to replace curbs at that point. R. Tallon moved <br />that ThirdP 'ederaZSavings and Loan will redo sidewalks to North <br />Olmsted Engineers specifications if new curbs are installed by <br />State of Ohio; alternate (if curbs are not installed) to be by <br />North Olmsted Engineer, seconded by J. Kazak, and unanimously <br />approved.
