Delmar IFIrnest, 30106 Lorain Rd. -- Request f'or ruling. <br />Present: Mr. Ernest a nd others -who were a dministered the oath. Letter <br />from Mr oErnest to P?`ir. Gundy, Building Commissioner, dated Sept. <br />81 1975 was read by Chairman Ledvina. Zetter of response dated <br />Sept. 10 from Mr. Gund,y to Mre Ernest was read by Chairman Led- <br />vina. Determination of per mitted use of Mr. Ernest's property, <br />Section 1133e09 in zoning ordinance and Section 1173.02, appeal <br />of Mr. Ernest (page 52 of zoning code) were read by Yse Ledvina. <br />Rreamble and. Section 8 and sub paragraph (A) are points to be <br />considered tonight. Specified portions of the ordinance were <br />read by Ntr. Ledvina, N'.r. Ernest gave his interpretation. Mr. <br />Ernest referred to 1968 Comprehensive Plang he commented that <br />those attending Citizens' Advisory Committee Meetings interpret- <br />ed plans to include 5 story apartments along Lorain Road where- <br />ever zoning is commercial. <br />Lava Director Gareau said intent must be considered., the intent in <br />the original code. Is the interpretation of which you speak con- <br />sis'cent with good practice and planning principles? Before Law <br />Director Gareau asked his next question he introduced expert wit- <br />? ness Robert C. Hill, Director of Planning of Dalton, Little and <br />NeVaport where he is employed as a City Planner. N?r. Hill is an <br />architect and has nad 17 years experience in community planning, <br />8 years with the Dalton organization,, 5 years as Senior Planner <br />Recycled Bond - One etep to eave oux enviroameat
