MINIITES OF A MEETING OF THE ZONING BOARD OF <br />APPEALS OF THE CITY OF NORTH OLMSTED HELD <br />SEPTEMBER 23rd, 1958, AT CITY HALL <br />Members present: Messrs. Ralph H. Parker, and Norval S. Snyder. <br />Absent: Walter A. Lindsay <br />The meeting was called to order at 7:30 P. M., by Mr. Parker <br />relative to the Public Hearing conducted to rezone property <br />to erect a four-car garage at 4990 Columbia Road. Mr. Masso <br />is in the tree surgery business and requested permission to <br />erect this garage. <br />Mr. Parker reviewed the case from its o*inal request, <br />Mr. J. R. Jack, 4989 Columbia Road represented the residents <br />of Columbia Roadg together with Mr. Dreher, 4995 Columbia Road, <br />Mr. W. Brewer and Mr. Krejci, 5174 Columbia Road. Mr. W. Brewer, <br />Attorney for Mr. Krejci, inquired whether or not a Notice of <br />Appeal had been presented. <br />Mr. Brewer made a motion to this Board that the request be refused <br />because no transcript was filed with the Building Department. <br />Article 15, Section 3 of the Zoning Ordinance was read, and the <br />Board of Appeals agreed the order of procedure was not followed. <br />The motion was seconded by Mr. Penyin, 4488 Columbia Road. Mr. <br />Brewer stated the procedure did not.conform to the legal procedure <br />of filing with the Zoning Board of Appeals, after a refusal by the <br />Building Commissioner. <br />Mr. Masso was also present, and was represented by Mr. Smith, a <br />Real Estate Dealer. <br />Mr. Parker stated that as long as this matter was not presented <br />in the proper legal manner, it is beyond the jurisdiction of the <br />Zoning Board of Appeals. <br />The meeting adjourned at 8:00 P.
