Byers, Greene, Schaaf, N1rs. Eia.l1 <br />Member absent: Mr. Klinite <br />Also absent: 2v1r. Gundy, Buslding Comtnissioner <br />1. Appe].lant: Bruscixlo Development, 15411 Chatfield jive. Cleveland, 0. <br />Ref: Rear Yard Setback variances on sublots 70, 74, ?S, 78, 83 <br />and 85 on Deerfield Urive and Sublot 13 on Fawn Drive in the <br />hianning Camnbell Subdivision #89 Section 1. Request is in <br />violation oi Zoning Ordinance 62-33, ChalDter 1163, sub-para- <br />graph 1163.01, ealliciz stipulates fifty feet. <br />hlr. Ray Bruscino represented Bruscino Development, and requested <br />that each lot setback variance be for ten f eet. Mre and Nirs. Paul <br />Lusf:er, 24833 Chase Drive were present. Mrs. Luster questioned <br />the variance on the grounds that the smaller back yards would tend <br />to restrict children's play activities. Mr. Schaai commented that <br />he believed the ]land area of the back yards seemed to b e adequate. <br />Mr. Luster questioned whether the v ariance request would a.f£ect the <br />poor drainage condition existing at the rear of his property. Then <br />Councilman Jack Pol.tz asked that the v ariance be denied because the <br />builder had not provided recreation areas as originally contemplated. <br />It was then pointed out by Mr. Bruscino that his company tivas not the <br />original developer, and that he had made no such commitmeiat. Mr. <br />Foltz withdreiv his objection. <br />Nire Schaaf said the city eiagineer should be conte.cted pertaining to <br />the drainage situation. 1vlrs. Luster said she would have Yio ob jec- <br />tion to tlie variance if the drainage problem could be corrected. <br />Mr. Bruscino said he would cooperate with the city engineer in <br />correctsng the drainage problem. At this point, Mr. Labas, city <br />engineer, was asked to appear. Subsequently, it ivas agreed that <br />Mr. Bruscino and interested property oivners vuould submit a letter <br />to the city enbineer to nave the grading work done to elitninate <br />the drainage problem on the rear of sublots 45 to 64 on Chase Drive. <br />Mr. Greene moved that the variances be granted for ten f eet rear <br />yard se-tback on the sublots in question. Mr. Schaaf seconded. Vote <br />ivas unanimous. <br />2. Appellant; 3ruscino Development, 15411 Chatfield five. Cleveland, 0. <br />Ref: Side street setback variance request on co rner sublots <br />Nos. 1, 217 22, 37, 57 in the Michael Varady Subdivision. <br />Request is in violation of Zoning Ordinance 62-33, Chanter <br />1159, paragraph 1159.02, which stipulates fifty feet.
