Appellant: Mr. Thomas J., Kennish., 3313 Columbia lid., Idorth Olmsted <br />ttef° Request for variance (1133.13) to build extension to rear of present <br />. garage, which is 12 ft. from side lot linee Extension to be 15 ft. <br />deep. -Request is for 32 ft. variance on extension 'uo side lot line. <br />Request is in violation of Zoning Ordinance Section 1151.04 (C) <br />whicli requires 5 feet between garage and side property line. <br />Mr. Kennish explained he had a permit dated June 10, 1964, to extend garage. <br />A,fter laying concrete footer and floor in July of this year, he was stopped <br />from proceeding. <br />Present were neighbors Mr. Derryberry., 3297 Columbia, Mr. M. L. Panaccione, <br />23405 r°2ap1e Adge,and IZr. Martin Racecie, 3341 Columbia, Mr. Racecie stated <br />the appellant was usang the gara;e as a place.of business in a residential area, <br />fixing cars belonging to other peoplee Parking cars behind t;he garage tsas an <br />eyesore. He objected to the noiee at night, and pounding. ile questioned why 60 <br />day terms of permit were not adhered to. T,Zr. Klinite read Section 1231.02 (B) o= the Zonini- Ordinance: Additions. A <br />nonconforming building shall not be altered, added to or enlarged unless the <br />additions and original building are made to conForm to the yard, coverabe and <br />height regulations of the district in zlihich it is located, except a nonconforming dwelling may be altered, modernized or en:Larged provi.ded -the altierations and <br />enlargements conform to a1l the yard regulations. <br />Mr. Kitchen, Law Directol, said that 1231.02 (B) is specii'ic. T-1e Zoning Board <br />does not have authority to grant a variance. <br />pIr. Greene said, on the basis of the Law °.j?irectorls apinion, he would move to <br />deny the appeal. •Second by Nrs. Bian. Vote.was unanimous. <br />24r. Klinite suggested Mr. Kennish contact -the Building -Commissioner regarding <br />the permit he had been granted., that he had a right to make a further appeal <br />if he had been misinformed regarding the righ-t to add to his nonconforming <br />garage. . <br />-2.
