.. __ i. <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLIVISTED <br />MINUTES OF FEBRUARY 2, 2012 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:02 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Michael Raig, Maureen Diver, Laura Bellido, Alfredo Lopez <br />Staff: Law Director Michael Gareau, Building Commissioner Dale Mitchell, Clerk of <br />Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Raig moved, seeonded by Ms. Diver, to approve the minutes of January 5, 2012 which <br />passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />John & Tracev McBride; 42601VIarquette Blvd. <br />Proposal consists of a three season addition, the following variance is requested: <br />An 11 ft rear yard variance for residence to close to the rear property line; code requires 50 ft., <br />applicant shows 39 ft., Section 1135.08(a). <br />Mr. Crossman with New Design & Remodeling and John McBride were sworn in. Mr. <br />Crossman said the room will be a 3-season only room. The room will be screened and <br />constructed using high quality materials. The composition of the floor will be a deck type with <br />post and concrete piers utilizing a portion of the existing declc. Ms. Diver asked if the addition <br />exceeded lot coverage with a pool, patio and shed remaining and Mr. Mitchell said no. Mr. <br />Lopez and Ms. Diver were concerned that if the variance was granted the patio could be <br />converted into livable space and the size of the addition and lack of green space would adversely <br />impact the neighborhood. Ms. Rudolph said lot coverage isn't exceeded and the yard is fenced <br />so visibility is minimized, therefore she had no objections. Mr. Raig said the corner lot which <br />has more restrictive setbacks is quite large, lot coverage isn't exceeded and the addition will <br />malce the yard more inviting. Ms. Bellido said the request enhances the use of the backyard. <br />Mr. Lopez moved, seconded by Ms. Rudolph, to grant John & Tracey McBride of 4260 <br />Marquette Blvd an 11 ft rear yard variance for residence to close to the rear property line; <br />code requires 50 ft., applicant shows 39 ft., Section 1135.08(a). Roll call: Lopez, Diver - no, <br />Raig, Bellido, Rudolph - yes, motion passed 3-2. <br />COMMERCIAL APPEALS AND REQUESTS <br />CMS11-25 BurlinlZton Coat F'actorv; Great Northern Plaza South: <br />Proposal consists of building & site modifications. <br />A special permit is required to add to a non-conforming building, Chapter 1165.02.
