CITY OF NORTH OLMSTED BOARD OF ZONING APPEALS MINUTES OF AUGUST 5, 2013 ROLL CALL Ms. Rudolph called the meeting to order at 7:05 p.m. in Council Chambers and led the Pledge of Allegiance. Present: Jennifer Rudolph, Laura Bellido, Michael Raig, Maureen Diver, Alfredo Lopez Staff: Director of Law Michael Gareau Jr., Director of Planning & Development Kim Wenger, Clerk of Commissions Donna Rote REVIEW AND CORRECTION OF MINUTES Mr. Raig moved, seconded by Mr. Lopez, to approve the minutes of July 1, 2013 which passed 4-0, Ms. Rudolph abstained. COMMERCIAI. APPEALS AND REQUESTS CMS13-21: Westfield Regal Cinema; 4952 Great Northern Mall Proposal consists of signage. The following variances are requested: Westfield: 1. A variance for 1 additional ground sign; applicant shows 13, Section 1163.27(a). Regal Cinema (wall signs 1, 2, 3 and 4): 1. A variance for 1 additional wall sign; code permits 1 per building unit, applicant shows 4, Section 1163.28(a). Note: BZA granted a variance for 3 wall signs in 2009. 2. A 68.2 square foot variance for sign face area (sign #1); code permits 100 square feet, applicant shows 168.2 square feet, Section 1163.28(c). Note: BZA granted a variance for sign height in 2009. 3. An 8'8" height variance for wall sign (sign #3), code permits 4 feet, applicant shows 22'8", Section 1163.28(c). Note: BZA granted a variance for a 14 foot high sign in 2009. 4. A variance for a sign (sign #3) projecting over the top edge of the wall, code requires sign to be at least 12 inches below top edge of wall, applicant show sign projecting over rooftop, Section 1163.28(b). The Rail Restaurant (wall signs 4, 5, and canopy signs A, B and C): 1. A 1 foot variance for height of wall signs (sign #5 and #6); code allows 4 feet, applicant shows 5 feet, Section 1163.28(c). 2. A variance for 2 canopy signs (signs A and B), code permits one per building entrance, applicant shows 3, Section 1163.29(a). 3. A variance for canopy signs (signs A and B) within 2 feet of other signage, code requires a minimum of 2 feet between canopy signage and all other signage, applicant shows less, Section 1163.29(c). The oath was administered to Phil Poppinga, Mike Walsh, Aiuiie Dorsey, Kelly Arnold, Bill Lockett, Mike Mariola, and John Swidrak. Also present was legal counsel John Slagter.
