The property is zoned General Retail Business. <br />The following variances are requested: <br />1. A 2 ft. variance for the height of a fence; code permits 6 ft., applicant shows 8 ft., Section <br />1135.02(f)(1). <br />2. A variance to install a high-tensile wire fence with weatherized posts, code does not permit <br />this fence type, applicant shows fence made of high tensile steel wire (12.5 gauge, class 3 <br />galvanized, rated at 200,000 psi) at 8 in. intervals with weatherized posts, Section 1369.02. <br />Mr. Aspery stated that the applicant is proposing to install an eight foot high, high-tensile wire <br />fence with weatherized posts that would enclose much of the backyard area. Code allows a <br />maximum fence height of six feet, and the applicant exceeds this height limit by two feet. Mr. <br />Kelley stated that the property is unique to the area. The Seltzer home was designated a North <br />Olmsted landmark and an orchard was originally part of the property. The applicants have <br />problems with deer eating the fruit and have exhausted other deterrents which have not <br />succeeded.
