?... <br />BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTEI) <br />MINUTES OF AUGUST 6, 2018 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:02 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Mike Raig, Eric Allain, Bob Papotto, Dan Rahm, Ralph Maclcey <br />Staff: Law Director Michael Gareau, Jr., Assistant Law Director Bryan O'Malley, Assistant <br />Building Commissioner Dan Russell, Planner James Aspery, Administrative Assistant Nicole <br />Rambo-Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the Building and Zoning Board of <br />Appeals minutes of July 2, 2018, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />18-11532; Greg Shimola; 23116 Clifford Drive <br />Representatives: Greg Shimola, 30755 Hilliard Boulevard, Westlake, OH; Dave & Cheryl Groff, <br />23133 Marion Road <br />Proposal consists of eliminating requirement for an accessory private garage. Property is zoned <br />C-One Family Residence. <br />The following variances are requested: <br />1. A variance to not provide a private garage in a one-family residential district; code requires a <br />private garage for each dwelling, applicant shows none; Section 1135.02(B)(1). <br />2. A variance for inadequate parking; code requires single family residential units to have a <br />minimum of two spaces, one of which is enclosed; applicant shows no enclosed parking <br />space; Table 1161.03-1, Parking Requirements by Use. <br />Note: It appears the garage was converted into a habitable space without the approval from the <br />Building Department. <br />Mr. Aspery stated that the applicant is seeking a variance to remove parking requirements for <br />their existing single family home. Because the applicant's attached garage was at one point <br />converted into a habitable living space, it eliminated the private garage requirement found in <br />Chapter 1135 and the enclosed parking requirement in Chapter 1161. Mr. Shimola said he <br />bought the house after the garage was converted and he believed it was done at least 30 years <br />ago. He thought there were approval stickers for work that was inspected when he bought the <br />home; nothing was mentioned about the garage at the time. Ms. Groff was concerned about <br />water drainage if another garage is built on the property. Mr. Russell wanted clarification on the <br />stickers. Mr. Shimola said the home was bank-owned before he bought it and believed the <br />stickers were for approval for electrical or plumbing work. Mr. Groff moved into the home in <br />1993 and the garage conversion was already done then. Mr. Shimola bought the home a year and <br />a half ago and uses it as a rental.
