CITY OF loTOItTgI OLMSTED <br />BOARD OF ZONYNG APPEALS <br />SEPTEMSER 1, 2005 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:30 pm. <br />PRESENT: Chairman J. Maloney, Board members; W. Kremzar, T. Kelly, M. D'aver and N. Sergi <br />ALSO PRESENT: Assistant Law I)irector B. O'Ma11ey, Assistant Building Commissioner T. <br />Rymazczyk, and Clerk of Cornmissions D. Rote. <br />Chairman Maloney advised that review and correction of minutes would be addressed at the end of <br />the meeting after the last case file. <br />ChaiYman Maloney reviewed that there were 2 cases carried over from August and 8 new cases <br />requesting 16 variances on the docket. He further advised that eacla board member had viewed the <br />premises involved for each case. Three votes are required for approval and in addition, each case <br />would be judged on the physical situation peculiar to itself, so that in no way is a judgment <br />rendered considered to be a general policy judgment affecting properties and like situations <br />elsewhere. <br />H. BiTILDING DEPARTMENT REQUESTS: <br />OLp BUSINESS: <br />• Woodscane Condominium (Rach I)enrnan); 22968 Mamle Ridge Road: (WRD 21 <br />Request for variance (1123.12). The proposal consists of replacing a ground sign <br />The following variances are requested: <br />1. A varianee for a ground sign located on a residential district, (code does not permit, applicant <br />shows 1), section (1163.26 (A)). <br />2. A variance for a billboard sign, (code does not permit, applicant shows 1), section (1163.29). <br />> <br />• > 9 <br />? <br />7 • <br />Which is in violation of Ord. 90-125 section; (1163.26 (A)), (1163.29), and (1163.26 (B)). <br />Note: Applicant requested to be tabled at the 8/4/05 Board of Zoning Appeals meeting. Applicant <br />eliminated variance request #3 by relocating the newly proposed sign. See letter dated 8/15/05. <br />Mr. Denman, with Sign Aroma, Ms. Ackermann, President of the Association, and the following <br />Board Members; Ms. Mackin, 1VIs. Sullivan, Ms. Corrigan, and resident Ms. Ha11, each came <br />forward to be sworn in and address the request. IVIr. Denman indicated that the existing wood sign <br />is deteriorating and the association would like to replace it. The nevv sign wotald withstand the <br />weather elements and is needed for recognition to identify the location of the facility. The existing <br />sign is 60" high and the new sign would be 72" high with the same width as existing ground sign. <br />Mr. Rymarczyk advised that the proposed location of the new sign is on the abutting neighbor's <br />property (Mrs. Ha11 properry owner). Mrs. Diver questioned why the sign was being placed on the <br />neighbor's property. Ms. Ackermann believed that for the most part the sign is on the <br />condomuuums land however there are about 3 or 4 inches of the sign which is on the neighbor's <br />propexry. The association was not aware of the issue until the contractor applied for the permit at <br />the Building Department. Mrs. Sergi questioned if the applicatxts could place the sign on their own <br />property. Ms. Ackermann suggested that the base would have to be replaced as well as the <br />1of10 <br />Page 3 of 6 Pages
