ROLL CALL <br />Chairman Koeth called the meeting to order at 7: 40 pm. <br />PRESENT: Chairman R. Koeth, Board members; W. Spalding, T. Hreha, M. Yager, J. <br />Lasko and S. Hoff-Smith. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Planning Director K. Wenger, <br />Assistant Building Commissioner T. Rymarczyk and Clerk of Commissions D. Rote. <br />REVIEW AND CORRECTION OF MINUTES: <br />The Planning Commission minutes from December 14, 2004 have been submitted for <br />approval. <br />R. Koeth moved to approve the December 14, 2004 Planning Commission minutes as <br />written. M. Yager seconded the motion which was unanimously approved. <br />III. COMMUNICATIOleTS <br />Ordinance No. 2004-200 <br />An ordinance amending sections 1115.02 and 1139.06 or the City's Zoning Code in order <br />better define and distinguish different categories of restaurants for zoning code purposes, <br />and to exclude small sandwich shops from the 1.5 acre minimum lot size requirement of the <br />general retail business district regulations. <br />Mr. Koeth asked for comments from the Planning Director. Planning Director Wenger <br />reviewed that Council has had a first reading on the ordinance and sent it to committee. The <br />Building Zoning and Development committee referred the ordinance to Planning <br />Commission for comments and recommendations. Once it returns to the Building Zoning <br />and Development committee they will review the recommendations and it will be placed on <br />Council docket for second reading. Once that meeting is completed there will be a third <br />meeting/reading for a public hearing and public notice will be published in the local papers. <br />At that time the general public is encouraged to give their recommendations to Council. <br />Ms. Wenger reviewed that Ordinance 2004-200 amends sections 1115.02 (Definitions) and <br />1139.06 (Lot Area and Width in a General Retail Business District) of the City's Zoning <br />Code. The amendment accomplishes two things. First, it better defines and distinguishes <br />three different types of restaurants. Second, it excludes the smallest, least intensive of the <br />three types of restaurants from the minimum square footage requirements for free standing <br />restaurants described in the Zoning Code. <br />The current version of the City's Zoning Code defines only one type of restaurant, which is <br />a fast food restaurant. There is no definition for restaurant or restaurants other than fast <br />food. Given the variety and types of restaurants available today, it is important to be able to <br />classify them separately as each of the three types of restaurants listed have different <br />considerations such as parking, traffic flow, circulation, and other site issues between what <br />would be considered for large sit-down full service, fast food, or coffee shop type
