CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />HELD IN COUNCIL CHAMBERS <br />OCTOBER 05, 2006 <br />MINUTES <br />1. ROLL CALL: <br />The meeting was called to order at 7:35 pm. <br />PRESENT: Members; J. Maloney, M. Diver,.J. Burke, N. Sergi and T. Kelly <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczyk and Clerk of Commissions D. Rote. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />N. Sergi moved to table the Board of Zoning Appeals minutes dated August 03 for additional <br />clarification. M. Diver seconded the motion which was unanimously approved. <br />J. Burke moved to approve the Board of Zoning Appeals minutes dated September 07, 2006 as <br />written. M. Diver seconded the motion which was unanimously approved. <br />Chairman Maloney reviewed that there were 6 cases requesting 15 variances and 1 special permit on <br />the docket. He further advised that each board member had viewed the premises involved for each <br />case: Three votes are required for approval and in addition, each case would be judged on the <br />physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a <br />general policy judgment affecting properties and like situations elsewhere. <br />'TI. RESIDENTIAL APPEALS AND REQUESTS: <br />1. Tom & Bonnie Mayne; 6056 Paislev Drive: (WRD # 3) <br />Request for variance (1123.12). The proposal consists of a 3 season room. <br />The following variance is requested: <br />1. A 12 foot rear yard variance for a residence to close to rear property line, (code requires 50', <br />applicant shows 38'). Which is in violation of Ord. 90-125 section; (1135.08 (a)). <br />Mr. Scheff the contractor and Mr. & Mrs. Mayne the owners each came forward to be sworn in and <br />address the request. Mr. Scheff reviewed that the intent was to enclose the exiting patio for the <br />owners therapeutic exercise and health. He suggested his clients spoke to 12 of their neighbors who <br />signed a letter stating they had no objections to the request. Mrs. Sergi questioned if the room was a <br />three season room would the owners still be able to use the room in the winter months. Mrs. Mayne <br />advised that a space heater would be used during the winter months so she could continue to use the <br />equipment. Mrs. Diver felt that the owners health issues and using the existing slab was founded <br />and she had no obj ections to the request. <br />M. Diver moved to grant Tom & Bonnie Mayne of 6056 Paisley Drive their request for <br />variance (1123.12), which consists of a 3 season room and the following variance is granted: <br />1. A 12 foot rear yard variance for a residence to close to rear property line, (code requires <br />501, applicant shows 38'). Which is in violation of Ord. 90-125 section; (1135.08 (a)). T. Kelly <br />seconded the motion which was unanimously approved. Variance Granted <br />2. Ed & Pat Morgan; 6072 Sandpiper Lane: (WRD # 4) <br />Request for variance (1123.12). The proposal consists of a new patio room.
