BOARD OF ZONING APPEAI.S <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES OF OCTOBER 04, 2007 <br />ROLL CALL <br />Chairwoinan Diver called the meeting to order at 7:35 pm in Council Chambers. <br />Present: Maureen Diver, Angela Williamson, Robert Menser and Nancy Sergi. <br />Absent: Terrence Kelly <br />Staff: Assistant Law Director Bryan O'Malley, Building Commissioner David Conway and <br />Clerk of Commissions Donna Rote. <br />Chairwoman Diver reviewed that there were 4 cases requesting 2 special permits and 26 area <br />variances. She further advised that each board member viewed the premises involved for each <br />case. Three votes are required for approval and in addition, each case will be judged on the <br />physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a <br />general policy judgment affecting properties and like situations elsewhere. The board will <br />address each of the seven standards when reviewing each case and every applicant was asked to <br />address all seven standards in their presentation. <br />! E : <br />REVIEW AND COI2RECTION OF MINUTES <br />Mrs.' ?ergi moved, seconded by Mr. Menser, to approve the September 6, 2007 Board of <br />Zonirig Appeals minutes as written whicla was unanimously approved 4-0. <br />? <br />RESIDENTIAL APPEALS ANI) REQUESTS: <br />Damiel & Karen Carson; 5639 Porter Road (VVard 3) <br />Request for variance (1123.12). The proposal consists of an addition. <br />The following variance is requested: <br />1. A.14 ;foot variance for front yard setbaclc for residential addition) code requires 50', applicant <br />shows 36'). Which is in violation of Ord. 90-125 section (1135.06 (a)). Note: BZA tabled <br />9/6/07. <br />Representatives: Karen Carson the owner and Mr. Tomplcins a neighbor were each sworn in to <br />review.. the request. <br />Mrs. Carson reviewed that they need the addition for her father in-law as his leg was amputated, <br />confiriing him to a wheelchair which her 3 bedroom ranch home can not accommodate. They <br />need to provide a fitting restroom and bedroom which can accommodate a wheelchair. Due to <br />the: ongoing health problems they are not sure he will ever be capable of using a prosthetic leg. <br />Currently her son is living in the living room and her father in-law must be talcen to the garage to <br />Ue Uathed and use the restroom. The interior layout of the home can not accommodate a <br />hanciicap addition. A rear addition would require removing the only restroom in the home to <br />create ?a hallway to the addition. Even if the bathroom is converted into a hall the wheelchair <br />woiiId not fit through the hall. Requiring the addition be placed in the rear would be an undo <br />hardship on their family both financially and emotionally. All building materials will match <br />those on the existing home both in material and colors used. She does not believe that the front <br />addition will be detrimental to the neighborhood as many homes along the street have front <br />additions. An architect was not hired as they do not have the funds to hire a licensed Architect or <br />redesign the entire interior of the home just to place the addition along the rear.
