BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES OF SEPTEMBER 06, 2007 <br />ROLL CALL: <br />Chairwoman Diver called the meeting to order at 7:35 pm in Council Chambers. <br />Present: Maureen Diver, Terrence Kelly, Angela Williamson, Robert Menser and Nancy Sergi. <br />Staf£ Assistant Law Director Bryan O'Malley, Building Commissioner David Conway and Clerk of <br />Commissions Donna Rote. <br />Chairwomar? Diver reviewed that there were 3 cases requesting 1 appeal and 4 area variances. She <br />further advised that each board member viewed the premises involved for each case. Three votes are <br />required for approval and in addition, each case will be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. The board will address eacli of the 7 standards when <br />reviewing each case and every applicant was asked to address a117 factors in their presentation. <br />REVIEW AND CORRECTION OF MINUTES: <br />M. Sergi moved, seconded by T. Kelly, to approve the minutes of August 02, 2007, as <br />corrected which was unanimously approved 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS: <br />1. Daniel Carson; 5639 Porter Road (WRD # 3) <br />Request for variance (1123.12). The proposal consists of an addition. <br />The following variance is requested: A 14 foot variance for front yard setback for residential <br />additiori) code requires 50', applicant shows 36'). Which is in violation of Ord. 90-125 section <br />(1135:06 (a)). <br />Daniel Carson the owner camE forward to be sworn in and address the case. Mr. Carson's <br />request was based on his father's handicap state which requires he reside in his son's home. Mr. <br />Carson didn't think his rear yard could accommodate the 14 foot addition due to the location of <br />his neighbor's home and his detached garage. The home is a single story ranch and he wanted to <br />provide his father his own entrance to his room and handicap bathroom. The main entrance will <br />be on the side of the home and the existing ramp and steps will just be turned. The building <br />commissioner felt the request was substantial and that the rear of the home could accommodate a <br />14 foot addition if properly designed. He would prefer rear area variances over front setbacks. <br />Tlie commissioner suggested the owner seek the help of an architect to design the addition on the <br />rear of the home in lieu of a general contractor. An Architect would be the best served to design <br />an addition with the applicants needs. Mrs. Sergi pointed out that some neighboring homes also <br />had sinall front setbacks so the character of the neighborhood would not be altered. Although <br />placing the addition along the rear of the home would be the least offensive. Mr. Kelly felt that a <br />rear addition would provide the applicant's father more privacy. Mrs. Diver inquired if the <br />applicant was willing to table the request and look into a rear addition and returning in October if <br />needed. The applicant reluctantly agreed to look into a rear addition and voiced his frustrations <br />regarding a professional architect being used due to financial constraints and his family's current <br />living arrangements. Mrs. Diver assured the owner that the board wanted to work with the <br />owrier and only wanted the best for the applicant. <br />N. Sergi moved, seconded by R. Menser, to table Daniel Carson of 5639 Porter Road until <br />meeting next which was unanimously approved 5-0.
