BOARI) OF BUILDING CODE APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR 1VIAY 22, 2008 <br />ROLL CALL <br />The meeting was called to at 5:35 p.m. in Council's chambers <br />Present: Donna Sabo, Norman Althen, Robert Lipcsey, BJ Meder, Dan Jarachovic <br />Staff: Assistant Law Director Bryan O'Malley, Building Inspector David Peltz, Clerlc of <br />Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Meder moved seconded by Mr. Althen, to approve the January 17, 2008 Board of Building <br />Code Appeals minutes as written which was unanimously approved 5-0 <br />NEW BUSINESS <br />I)avid Arth; 6257 Bri%Zhton Drive: (Ward # 3) <br />Proposal consists of a fence enclosing rear yard area BZA granted variances 5/1/08 as noted. <br />The following variance is requested: <br />1. A variance to install proposed fence section in rear yard which will run parallel to existing <br />neighbors fence on the other side of a CEI easement which is in violation of section 1369.03 (A <br />(3)). Note: 05/15/08 meeting canceled no quorum <br />Mr. & Mrs. Arth were present to review their request. Mr. Arth said they would like the board to <br />grant the variance to install the fence which will be 14 feet away from the neighbor's existing <br />fence and will be in line with other existing fences. The fence will be a board on board dog <br />eared 5 foot high fence with 4" boards and 2" spacers. He currently maintains the open area now <br />and will continue to do so once the fence is installed. There will be a gate along the house side <br />which will give him access to mow the area. Mr. Jarachovic is concerned that the open space <br />distance will create an alleyway which could become troublesome. Mr. Arth said there are <br />bushes sporadically planted throughout the open area to ensure an alleyway is not created. The <br />fence is to prevent their home from being vandalized again as did last year when school let out <br />and summer break started. Although they were aware that their home was in a school area they <br />were not aware there were issues with vandalism when they purchased their home. Mr. Peltz <br />said the building department had no objections to the request and noted that the Board of Zoning <br />Appeals granted the applicant variances for sideyard setbaclc, height and openness May 1, 2008. <br />Board members voiced that they had no objections to the request as long as the area is <br />maintained properly. Mr. Lipcsey cautioned the applicant to follow section 1369.03 (A (3)) <br />when installing the fence to ensure it was properly installed. <br />1VIr. Meder moved seconded by Mr. Lipcsey to grant David Arth of 6257 Brighton Drive a <br />variance to install a section of fence in the rear yard which will run parallel to existing <br />neighbors fence on the other side of a CEI easement which is in violation of section 1369.03 <br />(A (3)) and was unanimously approved 5-0.
