BOARD OF BUILDING CODE APPEALS <br />CITY OF NOIZTH OLMSTED <br />MINUTES FOR JANUARY 17, 2008 <br />ROLL CALL <br />The meeting was called to at 5:35 p.m. in Council's Caucus room. <br />Present: Norman Althen, Robert Lipcsey, BJ Meder, Donna Sabo, Dan Jarachovic <br />Staff: Assistant Law Director Bryan O'Malley, Clerk of Commissions Donna Rote <br />ELECTION OF CHAIR AND VICE CHAIR: <br />Mr. Althen moved seconded by Mr. Meder to elect Donna Sabo as Chair, which was <br />unanimously approved 4-0. <br />Mrs. Sabo moved seconded by Mr. Meder to elect Norman Althen as Vice Chair, which was <br />unanimously approved 4-0. <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Althen moved seconded by Mr. Lipcsey to approve the Board of Building Code Appeals <br />minutes dated October 18, 2007 as written which was unanimously approved 4-0. <br />OLD BUSIlo1E5S <br />NEW BUSINESS <br />Charter and informational replacement pages for member binders were received and it was noted <br />that not only did the clerk send the members replacement pages for chapter 13 but the building <br />commissioner did as well. The clerk will e-mail everyone an updated BBCA appointment sheet <br />with the minutes for review. <br />COMMUNICATIONS <br />Mr. O'Malley reviewed for board members their procedures and reviewed their role in the cities <br />approval process. He advised that the board's determinations are bound and can only be over <br />turned by the courts. He suggested the board should have rules of procedures as well as finality <br />forms for their rulings as does the Board of Zoning Appeals Board. It was recommended that the <br />board adopt swearing in owners/witnesses to present evidence for each case heard. It was <br />requested that he be allowed to draft up rules of procedures and finality forms with the clerk's <br />assistance for the board. He reviewed that there is a Board of Building Code Appeals in <br />Columbus which the board may be bound to which he will research to ensure the board is in line <br />with both state and local laws. Board members welcomed the Law Departments assistance on <br />making sure they are conducting their meetings properly. Mrs. Sabo felt that rules of procedures <br />would benefit not only the board members but the general public as well. There was discussion <br />as to listing what documents the board would like to have presented with an application as well.
