PLANNING & DESIGN COMIVIISSIO1oT <br />CITY OF NORTH OLMSTED <br />1dlINiJTES F'OR NOVEMBER 12, 2008 <br />ROLL CALL <br />Mr. Laslco called the meeting to order at 7:30 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: John Lasko, Ralph Bohlmann, Melissa Meredith, Jim Cotner, Angela Williamson, <br />Greg Malone <br />Absent: Don Rerko <br />Staff: Planning Director Kim Wenger, Assistant Law Director Bryan O'Malley, City <br />Engineer Dan Collins, Clerlc of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Laslco moved, seconded by Mrs. Meredith, to approve the Planning & Design <br />Commission minutes of October 22, 2008 as written. Roll call: Cotner, Lasko, Bohlmann, <br />Meredith - yes; Williamson, Malone - abstain. Motion approved 4-2. <br />COIVIMUNICATIONS <br />Ordinance 2008-131 <br />Ms. Wenger said she felt the minutes of the last meeting accurately reflected her concerns and <br />comments pertaining to the ordinance. She believes that the ordinance was introduced in <br />reaction to a particular project but needs to be loolced at in a broad sense as it will affect the <br />entire city and filture proj ects involving cluster rezoning. The ordinance sets a precedent of <br />requiring rezoning approval by the voters and places too great of a burden on the development <br />review process; therefore she opposes the legislation. Mr. O'Malley said the minutes of the <br />last meeting reflected his comments pertaining to the ordinance and encouraged the <br />commission to talce a broad view of the legislation as it affects the city, not just a specific <br />project or location. <br />Mr. Laslco read Mr. Rerko's written comments in which he stated the ordinance is not in the <br />best interest of the City by talcing away leadership responsibility froin elected officials <br />(attached). Mr. Bohlmann referenced other property disputes in the City, such as the Parcel E <br />development, and how the courts decided in favor of the developer. He also felt mistalces <br />were made in rezoning all of Lorain Road commercial. Now there are developments which do <br />not have proper buffering against residential lots. He tends to favor the ordinance as he has <br />seen land near his home which was rezoned to a zoning he does not believe fits the area. He <br />would be more comfortable if the ordinance required voter approval of rezoning of lots over a <br />certain size and was a vote of all residents, not just ward residents. <br />Mr. Lasko said the October 22, 2008 minutes reflected commissioners and residents comments <br />therefore he request past comments not be repeated. Councilman Orlowski said he <br />appreciated Mr. Bohlmann's comments and would look at them. Three other communities he <br />is aware of require voter approval for rezoning by charter. His ordinance would be much <br />easier to repeal than a charter change. He reviewed storm water issues related to Biddulph <br />Trail. He will worlc with Council to see what can be done to improve the ordinance. Mr. <br />McKay said that developers develop an area then sell it off for a profit and leave the area. The <br />1
