BOA.RD OF ZONING APPEALS <br />CIT4' OF NORTH OLMSTED <br />IVIEETING MINIJTES OF NOVEIVIBER 06, 2008 <br />ROLL CALL <br />Chairwoman Diver called the meeting to order at 7:30 pm in Council Chambers. <br />Present: Maureen Diver, Nancy Sergi, Laura Bellido, Jennifer Rudolph, Robert Menser <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Dale <br />Mitchell, Clerk of Cominissions Donna Rote <br />Mrs. Diver advised all board meinbers viewed each site and three votes were required for <br />approval. Each case is judged on the physical situation peculiar to itself, so that in no way is a <br />judginent rendered considered to be a general policy judginent affecting properties and lilce <br />situations elsewhere. Applicants were aslced to address all seven area variance standards noted. <br />REVIEW AND CORRECTION OF MINUTES <br />Ms. Rudolph moved, seconded by Mr. 1VIenser, to approve the Oetober 2, 2008 Board of <br />Zoning Appeals minutes as written, which was unanimously, approved 5-0. <br />RESII)ENTIAL APPEALS AND REQUESTS: <br />Wayne Palmer; 6145 Fitch Road; <br />Request for variance (1123.12). The proposal consists of replacing existing detached garage <br />The following variances are requested: <br />1. A 114 square foot variance for a detached garage larger than code allows (note #2) code <br />permits 750 sq ft applicant shows 864 sq ft section 1135.02 C1. <br />2. A 561 square foot variance for total garage space on a residential lot (note # 1& 2) code <br />permits 750 sq ft applicant shows1311 sq ft section 1135.02 C3. <br />Mr. Paliner the owner came forward to be sworn in to address the case. Mr. Palmer said he <br />would lilce to have a new 24' x 36' detached garage which would house two racecars and a <br />vehicle trailer. Although the plans show a carport/porch being added to the garage it will no <br />longer be built and the existing detached garage will be demolished. There is an attached two car <br />garage on his home now and the second garage will ensure the vehicles and trailer are out of the <br />elements and not an eye sore. Ms. Bellido aslced if the second variance was required without the <br />overhang. Mr. Mitchell said both variances were required as the maximum square footage for <br />garage on a lot is 750 square feet and with two garages proposed for the lot the total square <br />footage is 1311 square feet. He noted that in 1998 a variance was granted for a shed which is <br />being removed but due to the square footage of the lot the owner would be allowed a 200 square <br />foot shed in addition to having two garages. Mrs. Sergi questioned if what was being requested <br />was more of a pole barn than garage and aslced what the difference was. Mr. O'Malley reviewed <br />that city codes do not address or recognize pole barns. There are garages which can be no larger <br />than 750 square feet which includes a driveway or accessory structures which are regulated by <br />chart calculations based on the square footage of a lot. <br />Mr. Menser felt the variance was substantial but the neighborhood would not be altered as the lot <br />is so deep it would not be seen. The detached garage being removed is warranted as it loolcs to <br />be falling apart. If the variance is granted it should be limited to having no other accessory <br />structures added to the lot. Ms. Rudolph agreed with Mr. Menser that the variances are <br />substantial however the size of the lot is quite large and it does not exceed 20% lot coverage. <br />1
