BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF JULY 10, 2008 <br />ROLL CALL <br />Chairwoman Diver called the meeting to order at 7:45 pm in Council Chambers. <br />Present: Maureen Diver, Nancy Sergi, Laura Bellido, Jennifer Rudolph, Robert Menser <br />Staff: Clerk of Commissions Donna Rote <br />Mrs. Diver advised all board members viewed each site and three votes were required for approval. <br />Each case is judged on the physical situation peculiar to itself, so that in no way is a judgment rendered <br />considered to be a general policy judgment affecting properties and like situations elsewhere. <br />Applicants were aslced to address all seven area variance standards noted. <br />REVIE`V AND CORRECTION OF MINUTES <br />Ms. Rudolph anoved, seconded by 1VIrs. Bellido, to approve the June 5, 2008 Board of Zoning <br />Appeals minutes as amended, which was approved 4-0 as Mr. Menser abstained. <br />RESIDENTIAL APPEALS AND REQUESTS: <br />Rolbert Gilchrist Jr; 31490 Lorain Road: (Ward 3) <br />• A special permit to add to a non-conforming building is required section 1165.02. <br />Request for variance (1123.12), The proposal consists of an addition <br />The following variances are requested: <br />1. A variance from section 1165.02 as area variance is required <br />2. An 8 foot variance for a residence too close to the right of way code requires 50' applicant shows <br />42' which is in violation of Ord. 90-125 section 1135.06 (a). <br />Mr. Gilchrist Jr. the owner, Mr. Haendiges the contractor and Mr. Ray Gilchrist each came forward to <br />Ue sworn in and address the request. Mr. Haendiges said the owner would like to add a second floor to <br />add four Uedrooms. A porch is also being added to the front and side of the home. The addition will <br />not infringe the right of way any more then what it already does. Mrs. Sergi aslced why the addition <br />was needed. Mr. Gilchrist said that the addition would allow him and his son's family the living space <br />needed to adequately accommodate their family. Mr. Haendiges said that as the site had not been <br />surveyed could there be an issue if his measurements were a few inches off +/-. Mrs. Diver questioned <br />if the site had ever been surveyed. Mr. Gilchrist Jr. said he had owned his land for over 60 years and <br />the home was built around 1946 right after the war. Mr. Ray Gilchrist noted that Lorain Road had been <br />widened twice since his father owned the land which caused the home to be approximately 42 feet +/- a <br />few inches from the right of way. Prior to the street widening their family home met all zoning codes. <br />Board members reviewed the standards for granting a special permit and found that none of the <br />conditions would be created or caused by the addition, therefore they had no objections. Board <br />members felt that as long as the setbaclc was not being increased the addition would not affect the area. <br />Mrs. Sergi moved, seconded by Mr. Menser, to grant Robert Gilchrist Jr of 31490 Lorain Road a <br />special permit to add to a non-conforming building which is in violation of seetion 1165.02 and <br />unanimously approved 5-0. <br />1
