• • CITY OF NORTH OLMSTED <br />s <br />"TOGETHER WE CAN MAKE A DIFI'ERENCE" <br />BOAYtD OF ZONING APPEALS <br />MINU'Y'ES - NOVEMMER 4, 1999 <br />1. ROLL CALL: <br />Chairman, Gomersall called the meeting to order at 7:30PM. <br />PRESENT: Chairxnan, Gomersall, Board Members, T. Koberna, J. Maloney, J. Konold, and W. Kremzar. <br />ALSO PRESENT: Law Director, M. Gareau, Assistant Building Commissioner, T. Rymarczyk and Clerk of <br />Commissions, D. Rote. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />II. REVLEW AND CORRECTION OF MINUTES: The Board of Zoning and Appeals minutes of October 7, <br />1999 have been submitted for review. <br />J. Konold motioned to approve the October 7, 1999 minutes as submitted. The motion was seconded by W. <br />Kremzar and unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1. Terrence Kelleen; 6039 Paisley Drive: <br />Request for variance (1123.12). Proposal consists of building a shed. <br />The following variances are required: <br />A 24square foot (.5%) variance for exceeding 2% of rear yard. (Code permits 96sq ft, applicant shows <br />120sq ft). <br />Which is in violation of Ord. 90-125 section, (1135.02 D1). <br />Chairman Gomersall called all interested parties fonvard, and reviewed the variance requested. Mr. <br />Kelleen came forward to review his request. Chairman Gomersall commented that each of the board <br />members had visited the site and did not have any objections to the request. No further comments were <br />made. <br />J. 1Vlaloney motioned to grant Terrence Kelleen of 6039 Paisley Drive his request for variance (1123.12). <br />Which consists of building a shed and that the following variance be granted: <br />A 24square foot (.5%) variance for exceeding 2% of rear yard. (Code pernuts 96sq ft, applicant shows <br />120sq ft). Wluch is in violation of Ord. 90-125 section, (1135.02 D1). The motion was seconded by J. <br />Konold and unanimously approved. Variance Granted. In the framing of the motion Mr. Gomersall <br />questioned if the applicant would be placing the shed 10 feet from the property line. Mr. Kelleen <br />remarked "yes." <br />2. Beitel; 24207 Palm Drive: <br />Request for variance (1123.12). Proposal consists of a swimming pool. <br />The following variances are requested: <br />1) A 198square foot (6.4%) variance for swimming pool exceeding 20% rear yard coverage, (code <br />pernuts 620sqft, applicant shows 818sqft). <br />Which is in violation of Ord. 90-125 section, (1135.02 D2). <br />Chairman Gomersall called all interested parties forward, and reviewed the vanances requested. Mr. <br />Beitel came fonvard to review his request. Mr. Beitel indicated that he would like to have the variance <br />granted as well as the electrical violation. Mr. Koberna indicated that the board could not address the <br />electrical violation as it was not within the board's jurisdiction. Mr. Gomersall indicated that the pool was <br />too large for the size of the applicant's back yard. Mr. Koberna indicated that the board's picture showed
