i ^ <br />?., <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF BUII.DING CODE APPEALS <br />NIINUTES - SEPTEMBER 19, 2002 <br />IN COUNCIL CHAMBERS <br />5:30 P.M. <br />ROLL CALL: Chairman Puzzitiello called the meeting to order at 5:30p.m. <br />PRESENT: Chairinan Puzzitiello and board members, M. Conway, and P. Engoglia <br />ABSENT: R. Klesta, and N. Althen <br />ALSO PRESENT: Assistant Law Director: Bryan O'Malley, Assistant Building Commissioner: <br />T. Rymarczyk, and Assistant Clerk of Commissions: A. Kilbane <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The minutes of the June 201 2002 Board of Building Code Appeals meetings have been submitted for <br />approval. <br />P. Engoglia made a motion to approve the minutes as submitted. The motion was seconded by M. <br />Conway and unanimously approved. <br />III. BUII.,DING DEPARTMENT REQLTESTS: <br />1. Wal-Mart(Sherman Simms) 24801 Brookpark Road: <br />Proposal consists of Storage Trailers. <br />Applicant requests a permit for nine (9) trailers to be placed in an area, which is visible from Country <br />Club Blvd. right-of-way throughout the 2002 Christmas season. This is in violation of (section <br />1363.07 (b-5)). <br />Chairman Puzzitiello asked if there was a representative from Wal-Mart present to review the request. <br />Mr. Sherman Simms came forward on behalf of Wal-Mart. He indicated he is the co-manager of the <br />North Olmsted Wal-Mart. He said their request is for approval of the use of trailers at the store. Mr. <br />Engoglia,asked how many trailers are being requested. Mr. Simms said they are asking for approximately <br />nine trailers. There are six trailers on the diagram the board members received. Mr. Simms said they may <br />not use all the trailers, but he definitely needs the layaway trailers. He added the store is up for <br />remodeling next year, which would eliminate the need to keep coming before the board. He indicated he <br />does not like operating out of trailers but the store has been very successful and they need the space. Mr. <br />Conway asked if they have considered building an area where they could store excess inventory. Mr. <br />Simms said they do not have that type of facility. They are working on it right now, so he may not need <br />all of the trailers. The layaway trailers will only go away with the enhancement of the building. Mr.. <br />Rymarczyk asked if there are six trailers there now. Mr. Simms indicated there are trailers there <br />currently. Mr. Puzzitiello indicated there are seven trailers there. Mr. Rymarczyk said they do not have <br />approval for them. Mr. Siinms pointed out that he was out of town for two weeks and the trailers were <br />there when he returned. He was quite upset about it. He said it is very expensive to bring trailers in-and <br />out and the people at the store knew they were supposed to wait until Mr. 5imms came before the board. <br />Mr. Simms said he is trying to build a better relationship with the city and putting the trailers there was <br />not the right thing to do. Mr. Engoglia asked if is asking for nine trailers plus the six that are there. Mr. <br />Simms said he is asking for a total of nine. He needs three for layaway items and he is working on <br />something to alleviate the need for the six others. He said the six trailers that are over by the wall in the <br />back are used for holiday products coming in. Mr. Engoglia pointed out that he spoke with Mr. Simms <br />before the last meeting and then no one showed up for the meeting., Mr. Simms indicated there was a <br />misunderstanding regarding the meeting and he apologized to the board.
