ROLL CALL: Chairman Puzzitiello called the meeting to order at 5:30 p.m. <br />PRESENT: Chairman Puzzitiello, and Board Members, R. Klesta, M. Conway, P. Engoglia, <br />and N. Althen ALSO PRESENT.: Assistant Law Director, B. O'Malley, Building Commissioner, D. Conway, <br />and Assistant Clerk of Commissions, A. Kilbane <br />H. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Building Code of Ap.peals minutes dated May 16, 2002 have been submitted for <br />approval. <br />P. Engoglia motioned to approve the Board of Building Code of Appeals minutes dated May 16, 2002 <br />as submitted. The motion was seconded by M. Conway and unanimously approved. <br />III. OLD BUSINESS: <br />IV. NEW BUSINESS: <br />1. 7ohn & 1Vlartha`Wri?ht- 4327 Coe Ave:: Proposal consists of a fence.. Applicant requests.a variance to be allowed to erect a fence along a <br />i common propei-`ty _line on which there is an existing fence. Which is in violation of section, (1369.03 <br />(a-3) j: Note: This proposal was tabled at :the May 16, 2002 Board of Building Code of Appeals <br />meeting. <br />Mr. Puzzitiello called Mr. Wright forward to discuss the proposal. Mr: Engoglia asked if Mr. Wright <br />is the person who got thepermit, rvith the neighbors who did not get a permit. W. Wright confirmed <br />that he did obtain a permit :and his _neighbors did not. Mr. Engoglia suggested that the board do <br />sometliing for Mr. Wright:; , Mr, D. ,.Conway, .the Building ?Commissioner, pointed out that the permit <br />was issued urider er'rorieous' =informatiori. The Building Department was _lead to believe the fence <br />belonged to the people on _Coe Ave: Once it was determined that it did not belong to them, they had <br />to rescind the permit: IVIi-; Puzzitiello_asked if the=fence belonged to the people on Bentley and that <br />was confirined -by 1VIr:' D.. Conway.? 1VIr Conway said when tfie application was made they were lead <br />to believe the, fee belonged :to the Wright's :and.they were going to remove it -and install a new fence. <br />He said .it, was l ncater discovered:that?it belonged to.-thepeople on Bentley, so they fiad no right to <br />: ... . . <br />. before the, board anyway seeking a variance to put up a fence along <br />remove 'it.and -he would ?have been : <br />side a fence already there: = In -the :interim the other r.esident took down a fence which %s within her <br />rights, :but she did not have, a right to put one back.up. Mr. Engoglia asked if Mr. Wright has free <br />reign to put lus fenceup now.,7-1VIi-. D. Coriway sa'id the lots are off set and there was a permit issued in <br />1963 or 1967. where a. previous owner of that property ran a 24 foot fence across the back of his <br />property because that is how much fence would have been missing. Mr_ D. Conway said he would <br />give him a permit up to that point un7ess there isalready a fence behind it. He indicated he had not <br />" visited the .site :but ther'e. is still the conflict` of fence on ferice: Mr. Puzzitiello said there are 2 fences, <br />one is a basket, weave and the other. is a white picket fence. W. Wright said he had the property <br />surveyed and the pin-is-about a.`half-inch-on the neighbors property. Mr. D. Conway pointed out the <br />conflict is putting up a second fence and it.is up.to the board to determine if they will.grant a variance <br />for that. He said he understands the other person put up a different kind of fence. W. Klesta said it is <br />a totally different style. 1V1r: Puzzitiello asked N1r. Wright what he would like to do. Mr. Wright <br />indicated he would like to have the same type of fence that was there before. He pointed out the fence
