r ,
CITY OF NORTH OLIV'ISTED
"TOGETHER WE CAN IMAKE A DIFFERENCE"
BOAIZD OF BUILDING CODE APPEAL5
MINUTES - MAY 16, 2002
IN COLTNCIL CHAMBERS
5:30 P.M.
ROLL CALL:
Chairman Puzzitiello called the meeting to order at 5:40 p.m.
PRESENT: Chairman R. Puzzitiello, Board members; R. Klesta, N. Althen M. Conway and P.
Engoglia.
ALSO PRESENT: Assistant Building Commissioner, T. Rymarczyk and Clerk of Commissions
D. Rote.
II. REVIEW AND CORRECTION OF MINUTES:
The Board of Building Code of Appeals minutes dated April 18, 2002 were submitted for
approval.
P. Engoglia motioned to approve the Board of Building Code of Appeals minutes dated April
18, 2002 as submitted. The motion was seconded by R. Puzzitiello and unanimously approved.
III. OLD BUSINESS:
R. Klesta motioned that all split rail fences less than 12-feet in length are to be considered
esthetics or landscaping and not an issue for the Board of Building Code of Appeals board. It
will be up to the Building departments discretion for those issues. The motion was seconded by
P. Engoglia and unanimously approved. Motion Carried
Discussion on the motion; Mr. Engoglia questioned why a 12-feet section. Mr. Klesta indicated
that that would be less than two whole fence sections, which would be 16-feet. This would
allow one whole 8-foot section and a portion of a second section.
IV. NEW BUSINESS:
1. Wal-Mart Store # 2316; 24801 Brookpark Road:
Proposal consists of storage trailers remaining on lot. Applicant requests a variance to be
allowed to have 5 merchandise trailers in the Southeast corner of the lot until 6-30-02. This is
in violation of section 1363.07 (b-5). Storage trailers are currently in the southeast corner of lot
and are visible from Country Club Blvd. Right-of-way.
Chairman Puzzitiello called all interested parties forward to review the request. As no one came
forward, Mr. Puzzitiello indicated that the board would address the second proposal and come
back to Wal-Mart.
Mr. Puzzitiello called again for Wal-Mart, but no one came forward. Mr. Engoglia suggested
the board address the request whether or not a representative is present or not. Mr. Puzzitiello
indicated that Wal-Mart had requested a variance last year. The board granted the variance and
gave the applicant recommendations to eliminate the need for variances every year. The
applicants can plant trees to make sure the trailers are hidden from the right-of-way. The City
understands Wal-Mart is doing well and needs additional storage space. However, Wal-Mart
should think about an addition to the existing building. The City is glad that Wal-Mart is doing
