CITY OF NORTH OLMSTED
"TOGETHER WE CAN MAKE A DIFFERENCE"
BOARD OF BUILDING CODE APPEALS
MINiJTES - APRIL 21, 2003
IN COUNCIL CHAMBERS
5:30 P.M.
I. ROLL CALL:
Vice Chairman R. Klesta called the meeting to order at 5:40 p.m.
PRESENT: Vice Chairman R. Klesta and Board Members; N. Althen and M. Conway.
ALSO PRESENT: Building Commissioner D. Conway and Clerk of Commissions D.
Rote.
ABSENT: Chairman R. Puzzitiello and board member P. Engoglia
II. REVIEW AND CORRECTION OF MIlNUTES:
The minutes of the March 20, 2003, Board of Building Code Appeals have been
submitted for approval.
R Klesta motioned to approve the March 20, 2003 minutes as written. M. Conway
seconded the motion, which was unanimously approved.
III. BUII.DING DEPARTMENT REQUESTS:
1. Doug Fenderbosch; 5140 Dewev Road:
Proposal consists of a pond.
A variance to not erect a fence around pond (code requires a fence), section (1345).
Vice Chairman Klesta requested the Building Commissioner give his opinion on the new
plans. Mr. D. Conway reviewed that the applicant was asked to return with plans similar
to Saint Clarence church for the board to review. Mr. Fenderbosch suggested that the
block has been delivered and stones will be delivered tonight and he will follow the plans.
His understanding is that he needed to place stones about 12 inches high around the pond
to make the area visible. Mr. Klesta suggested raising the rear blocks to 18 inch high and
then taper the blocks on the sides downward to the front, which would be 10 inches high.
Mr. Fenderbosch agreed that tearing down the block back to front would work. He has
enough blocks to taper. Mr. Althen questioned if the board would still require rod iron in
the front with the back and sides tapered. Mr. Klesta voiced that he felt the rod iron
would be more of a hindrance then a benefit. The board would be happy with a rear wall
at 18 inches then taper the two side from 18 inches downward to 10 inches when they
reach the front of the pond. Mr. D. Conway questioned if the board members were
referring to the 7-foot dimension. Mr. Klesta answered "yes". No further comments were
made.
R. Klesta motioned to approve Doug Fenderbosch of 5140 Dewey Road his variance
to not erect a fence around a pond as amended and agreed to. The pond will have an
18 inch rear perimeter wall with at least half the side walls being 18 inches high then
stepping down to reach a 10 inch height in the front of the pond. The front of the
pond will be 10 inches high with the stone placed on top. M. Conway seconded the
motion, which was unanimously approved.
