CITY OF NORTH OLMSTEID <br />BOARD OF ZONIle1G APPEALS <br />OCTOBER 7, 2004 <br />MIl`1iJTES <br />I. 1tOLL CAI.,L: <br />Chairman Maloney called the meeting to order at 730 p.m. <br />PRESENT: Chaurnan J. Maloney, Board members; W. Kremzar and M. Diver. <br />ALSO PRESEN'T: Assistant Law Director B. O'Malley, Planning Director K. Wenger, Building <br />Commissioner D. Conway and Clerk of Commissions D. Rote. <br />ABSENT: Board members N. Sergi and T. Kelley. <br />Chairman Maloney reviewed that there were 6 cases requesting 11 variances and 2 special <br />permits on the docket. He further advised that the board members had viewed the premises <br />involved for each case. Three votes are required for approval. In addition, each case will be <br />judged on the physical situation peculiar to itself, so that in no way is a judgment rendered <br />considered to be a general policy judgment affecting properties and like situations <br />elsewhere. <br />H. REVIEVV AND CORRECTION OF MIlNCTTES: <br />The Board of Zoning Appeals minutes dated September 9, 2004 have been submitted for approval. <br />W. Kremzar moved to approve the September 9, 2004, Board of Zoning Appeals minutes as <br />written. J.1VYaloney seeonded the motion, which was unanimously approved. <br />Chairman Maloney advised the audience that the order of the docket would be changed and the <br />board would address Corner Stone Plaza first. <br />III. SUII.DING DEPARTMENT REQUESTSs <br />Corner Stone Plaza. 23420 Lorain Road, WRD 2: <br />Request for variance (1123.12). The proposal consists of renovations and addition to existing <br />building. <br />The following variances are requested: <br />A special permit for alterations and adding to a non-conforming structure, as the existing building <br />does not meet the current requirements for the 75-ft. front setback, section (1165.02 (b) (1)). <br />1. A 16 foot variance for setback from right-of-way line to parking on corner lots, (code requires <br />minimum of 20', applicant shows 4'), this setback area is required to be landscaped, section <br />(1139.08 (a)). <br />2. A 10 foot side yard setback for west property line, (code requires 10', applicant shows 0'), this <br />area is also required to be landscaped, section (1139.07). <br />3. A variance for 3 luminaries at north property line, (code requires full cut-off, applicant shows <br />none), section (1161.12 (d)), (see note 1). <br />4. A variance for luminary mounting height at north property line, (code does not permit, applicant <br />shows 3 at 14' 6"), section (1161.12 (e)). <br />Note: Although luminaries are not full cut off as defined in the zoning code, house shields are to be <br />installed so no light shines to the north. <br />Which is in violation of Ord. 90-125 sections (1165.02 (b) (1)), (1139.08 (a)), (1139.07), (1161.12 <br />(d)) and (1161.12 (e)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. Montgomery with <br />corner stone plaza came forward to be sworn in and address the proposal. They would like to reface <br />and add to the existing building and have met a few times with the city to achieve a plaza that will <br />best suite the cities needs as well as their own. The board asked how fire equipment and delivery <br />trucks were going to maneuver the site. The applicant felt that delivery trucks could maneuver the
