Ir <br />CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION <br />MINUTES - MARCH 16,1998 <br />7:30 P.1VL <br />I. ROLL CALL: <br />THE REGULAR MEETING OF THE CIVIL SERVICE COMMISSION OF MARCH 16,1998 WILL NOW <br />COMMENCE.... PRESENT ARE: Chairman Cummings, Commissioner Zolar, Commissioner Thomay, also <br />present are Personal Director Popa, Police officer Kilbane Clerk of Commissions Cornish, and Assistant Clerk <br />of Commissions Rote. <br />H. DISPOSITION OF MINUTES: Any additions or corrections to the minutes of the January 28. 1998 and or <br />February 23, 1998 minutes. L. Zolar motioned to approve the minutes of January 28, 1998 and February <br />23, 1998. Seconded by E. Cummings and unanimously approved. <br />III. REPORTS: <br />A) There were 13 correspondences received and sent. The secretary read through the :correspondences that <br />were received and sent. For a complete list of such correspondences, please see list attached to end of <br />minutes. <br />IV. OLD BUSINESS: <br />V. NEW BUSINESS: <br />A) The Police Sergeants Written test was held on January 10, 1998. Clancy & Associates administered the <br />examination. The results were revealed at the January 19, 1998 Civil Service meeting. The police officers <br />that participated were notified of their results and given the opportunity to review/protest the written <br />examination. Final results of the written test were distributed to all police officer candidates following the <br />commissions review of any protests. The top 6 candidates were also informed of their seniority and <br />evaluation points and asked to review them for accuracy. Two officers had protests concerning the seniority <br />and evaluation distribution and both protests were submitted to the Law Department for opinion. The <br />assessment test was to be administered by the Ohio Association of Chief's of Police on Saturday, March 14, <br />1998. The commission needs to make a decision on protests concerning seniority and evaluation then reveal <br />the results, if they have been received. Assistant Clerk Rote stated assessment test results have not been <br />received. E. Cummings stated now would be the time to address the protests from the police department, we <br />will address Mr. Kilbane's request first since he is present. Mr. Kilbane stated that he was informed by a <br />staff representative from the Ohio labor council of police that I'm eligible for seniority credit for service <br />with another municipality within Ohio as long as I'm in the same job classification, I served more then four <br />years with the South Euclid police department prior to being hired by North Olmsted. My attorney <br />researched the case law and found a case out of Lakewood that was identical to my situation here, and it <br />went all the way to the appeals court and they decided that prior police service with another municipality <br />should be counted for seniority credit, and that was held up in the Ohio supreme court decision I referenced <br />to in my letter. So according to the calculations method that the commission is using I believe that I would <br />be entitled to an additional 2.4 points. Mr. Cummings inquired as to how Mr. Kilbane calculated the .4 of <br />the points. Ms. Cornish stated that she had a copy of the scale for the commissioners to look at. Mr. <br />Thomay stated that the law departments letter gave a recommendation as to what they should do. Mr. <br />Cummings stated that the law director recommends that you be granted your points from your last police <br />department, and I'm in agreement with them and am open for a motion on the matter. Ms. Cornish asked <br />the commissioners to please state the amount of points that Mr. Kilbane will be granted in the motion. <br />During the process of Mr. Cummings making a motion two police officers came in the room and ask to <br />speak about Mr. Kilbanes protest. Mr. Cummings stopped his motion and asked the police officers what <br />their names were. Officer Victor Branscum from the North Olmsted police department introduced himself, <br />then Detective David Huspaska introduced himself. Mr. Cummings stated that there were two protest that <br />the board was going over tonight, one is a protest from Mr. Huspaska about points, the other is Mr. <br />Kilbane's protest for additional points. Officer Branscum stated they were here concerning officer Kilbanes <br />
