` CITE' OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />CIVIL SERVICE COMMISSION <br />HEARING MINUTES —OCTOBER 4, 1999 <br />7:00 PM <br />I. ROLL CALL: <br />Chairman Cummings called the hearing to order at 7:15pm. <br />PRESENT: Chairman, E. Cummings, Board member, J. Thomay and L. Zolar. <br />ALSO PRESENT: Police Chief, Ruple, Assistant Law Director, Dubelko, Detective, <br />Branscum, Police Captain, Whelan and Civil Service Secretary, D. Rote. <br />II. DISPOSITION OF MINUTES: As the meeting was called for purposes of a hearing no <br />disposition of minutes will take place. <br />III. REPORTS: No items. <br />IV. OLD BUSINESS: <br />Chairman, Cummings indicated that Mr. Deucher's hearing would be addressed. Mr. Dubelko <br />commented that for the law department, the letter that was sent to Mr. Deucher indicated that <br />the procedures that would be followed would be that the City would put out evidence as to <br />the reason for the disqualification from the list. The applicant would then have an opportunity <br />to deflect that. Mr. Dubelko commented that, that was not the right procedures under the <br />Civil Service rules. The procedures for removal from the entry-level list are a little bit <br />different. The Cities obligation is to only state a reason for removal, which they have in their <br />letter to you. You are then given the opportunity to give any evidence you may have to rebut <br />that or to show that the reason is not valid. Because of the fact that the Commissions letter <br />was not worded as it should be indicating the right procedures, if this causes you an problems <br />you can request a continuance to prepare and it would be set for the next Civil Service <br />meeting date. Or if it doesn't cause you any problems we can go forth with the hearing now. <br />Mr. Deucher indicated that it did not cause him any problems and he would like to go forth <br />with the hearing. Mr. Cummings reviewed the reason Mr. Deucher was removed from the <br />entry-level list. Mr. Deucher gave his reasons for not being able to schedule a date to take the <br />polygraph and how he felt that the North Olmsted Police department should offer the tests on <br />the weekend or use other municipalities results. Mr. Dubelko reviewed to the Commissioners <br />things that should be taken into consideration and that the Commissioners could ask the <br />officers involved questions and then base their opinions on the finding. Mr. Cummings <br />questioned Detective Branscum as to what his phone conversations were with Mr. Deucher. <br />Detective Branscum reviewed the conversations that took place with Mr. Deucher and <br />indicated that polygraph tests were only given during normal business hours Monday through <br />Friday. Police Chief Ruple reviewed that the Detectives have never given polygraphs on <br />weekends and that they do their own polygraphs. Mr. Deucher commented that he was in a <br />position that he had just started working for the Lakewood Police department and did not <br />want to jeopardize his position there and prior to him signing the release form the North <br />Olmsted Police department contacted the Lakewood Police. Mr. Cummings indicated that if <br />he were an employer trying to arrange an interview he would contact an employer to reach the <br />candidate. Mr. Thomay questioned Mr. Deuchers position with the Lakewood Police <br />department and asked which municipality he would rather work for. Mr. Deucher indicated <br />that he was in the field -training program and he would rather work for North Olmsted as he <br />grew up in North Olmsted.
