II. <br />\ o� <br />rA <br />CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING <br />CITY COUNCIL CAUCUS ROOM <br />MINUTES - DECEMBER 15, 2008 <br />7:00 P.M. <br />ROLL CALL: Chairman M. Ubaldi called the meeting to order at 6:58 p.m. <br />PRESENT: M. Ubaldi and B. Hohmann <br />ALSO PRESENT: Human Resources Director C. Farver, Director of Public Safety L. Thomas, <br />Firefighter D. Boatman, Police Lieutenant M. Kilbane, Firefighter T. Kirkpatrick, Patrol Officer C. <br />Fioritto, Fire Captain M. Ciarrone, Firefighter M. Peters, Police Lieutenant R. Flynn, Firefighter R. <br />Pinkie, Fire Captain J. Hohenfeld, Firefighter K. Zywiec, Firefighter J. Knipper, A. Knipper, <br />Assistant Law Director B. O'Malley, and Civil Service Secretary D. Eccleston <br />DISPOSITION OF MINUTES: <br />The Civil Service minutes dated November 17, 2008 and November 24, 2008 have been submitted <br />for approval. <br />Mr. Ubaldi made a motion to accept the minutes as submitted. Mr. Hohmann seconded the <br />motion and unanimously approved. <br />COMMUNICATIONS: <br />There were 4 items of correspondence received and 7 items of correspondence sent out by the <br />Civil Service Commission. <br />IV. OLD BUSINESS: <br />Rules and Regulations Handbook <br />A recommendation was made for two (2.) revisions to the Rules and Regulations Handbook: 1) <br />codify the 2006-2 legal opinion from Law Director, James Dubelko, so there is no confusion on the <br />Commission's part where their jurisdiction lies and where it ends; 2) recommend to simplify the <br />last sentence that refers to only conditions under which abolishment can occur under the Ohio <br />Revised Code and in Section b draw directly from language from the 2006-2 legal opinion in Rule <br />XI, Layoffs, Section 3, Abolishment of Position. This is only in the abolishment of a position that <br />the Commission requires rationale, supporting documentation, and the filing of the notice of <br />abolishment. Section 7 extends the demarcation line between what the Civil Service Commission <br />does and what is handled by the collective bargaining agreements. <br />The draft of Rule XI, Layoffs, Section 3, Abolishment of Position is as follows: <br />
