CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING <br />CITY COUNCIL CAUCUS ROOM <br />MINUTES — MARCH 16, 2009 <br />7:30 P.M. <br />ROLL CALL: Chairman M. Ubaldi called the meeting to order at 7:33 p.m. <br />PRESENT: M. Ubaldi and B. Hohmann <br />ALSO PRESENT: Human Resources Director C. Farver, Assistant Law Director B. O'Malley, <br />Civil Service Secretary D. Eccleston <br />DISPOSITION OF MINUTES: <br />The Civil Service minutes dated February 23, 2009 have been submitted for approval. <br />Mr. Ubaldi made a motion to accept the minutes as submitted. Mr. Hohmann seconded the <br />motion and unanimously approved. <br />111. COMMUNICATIONS: <br />There was I item of correspondence received and no items of correspondence sent out by the <br />Civil Service Commission. <br />The Commission has received the State annual report from the State Personnel Board of Review. <br />The secretary has completed this form in the past and was reviewed by the Commission. Once <br />accepted, a motion was made to return the completed report back to the State. <br />IP�#]K M-10MM33 <br />Rules and Regulations Handbook <br />The Chairman is reviewing the handbook and hopes to have this task completed in two (2) months <br />time. What was discussed earlier regarding the handbook was some house cleaning of combining <br />the three (3) doc-aments that constitutes the Rules and Regulations Handbook which are: Table of <br />Contents, Preface and the main body of rules. They have been separate for years. The Commission <br />had followed the Legal Opinion 2006-02 from the Law Director, James Dubelko, in regards to <br />changes in the hierarchy. For example the changes that Director Limpert has made both at the <br />Waste Water Treatment Plant and the Service Department; also Director Dailey has made at the <br />Recreation Center. The Commission has home rule authority and there is a very significant power <br />vested in the Commission by Charter and the Charter was amended to make specific reference to <br />the Commission's authority to enact regulations that divert from State Law. In many instances, the <br />rules adopted and incorporate State Law and if there is going to be a conflict with State Law its best <br />that the rules make that fairly clear. Legal Counsel will review the legal opinion and will trace that <br />and ,the Charter ,into the,rule book. <br />
