BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF APRIL 1, 2019 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:05 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Mike Raig, Eric Allain, Bob Papotto, Ralph Mackey <br />Absent: Dan Rahm <br />Staff. Law Director Michael Gareau, Jr., Assistant Building Commissioner Dan Russell, Planner <br />James Aspery, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Mackey, to approve the Building and Zoning Board of <br />Appeals minutes of March 13, 2019, motion passed 3-0, Mr. Papotto abstained. <br />RESIDENTIAL APPEALS AND REQUESTS <br />19-13289; Richard Mahon; 4584 Azalea Lane <br />Representatives: Rick Mahon, owner <br />Proposal consists of an addition on the rear of the home. Property is zoned A -One Family <br />Residence. The following variance is requested: <br />1. A 13 ft. 5 in. variance for rear lot setback; code requires 50 ft., applicant shows 36 ft. 7 in., <br />Section 1135.06(D). <br />Mr. Aspery said the applicant is requesting a variance of 13 feet 5 inches to allow for a 560 <br />square foot addition to the rear of their home. The rear yard setback from the house is currently <br />56 feet 7 inches and the proposed addition would reduce the setback to 36 feet 7 inches. Code <br />requires a rear yard setback of no less than 50 feet. Mr. Mahon said they would like to a bedroom <br />and bathroom to the lower level so the home would be handicap accessible for themselves and <br />their elderly parents. Mr. Mackey asked if any utilities come through the swale behind the house, <br />Mr. Mahon did not think he would be taking on any risks by building the addition. Mr. Papotto <br />said there were a couple other houses in the neighborhood with additions on the rear of the home <br />and he did not think it would affect the rear neighbors since the lot is so deep. <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the following variance for 19- <br />13289; Richard Mahon; 4584 Azalea Lane: <br />1. A 13 ft. 5 in. variance for rear lot setback; code requires 50 ft., applicant shows 36 ft. 7 <br />in., Section 1135.06(D). <br />Motion passed 4-0. <br />19-13306; Brian & Melissa Walling; 5851 Barton Road <br />Representatives: Brian Walling, home buyer; Joann Winkler, owner's real estate agent <br />
