BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINTUES OF FEBRUARY 3, 2020 <br />ROLL CALL <br />Vice Chairman Allain called the meeting to order at 7:01 pm in Council Chambers and led the <br />Pledge of Allegiance. <br />Present: Eric Allain, Ralph Mackey, Bob Papotto, Suzie Patton, Dan Rahm <br />Staff. Law Director Michael Gareau, Jr, Planning Director Kim Lieber, Assistant Building <br />Commissioner Dan Russell, Planner Maria Levanoff, Administrative Assistant Nicole Rambo - <br />Ackerman <br />BOARD ORGANIZATION <br />Mr. Mackey moved, seconded by Mr. Papotto, to elect Mr. Allain as Chair, motion passed <br />5-0. <br />Mr. Mackey moved, seconded by Mr. Papotto, to elect Mr. Papotto as Vice Chair, motion <br />passed 5-0. <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of January 6, 2020, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />19-15747; Sharon Cooney; 3270 West 231s' Street <br />Representatives: Sharon Cooney, owner; Ronald Polash, NEO Fence, 14855 Broadway Avenue, <br />Maple Heights, OH <br />Proposal consists of a fence on a corner lot. Property is zoned C -One Family Residence. Case <br />was tabled at the January 6, 2020 meeting. <br />The following variance is requested: <br />1. A 9 ft. variance (approximate) for setback of a fence constructed on a corner lot in the side <br />and rear yards abutting a side street; code requires 20 ft., applicant provides approximately <br />11 ft. to align the fence with the side of the house, Section 1135.02(D)(3). <br />Note: No precise dimension to the side property line has been provided but it is the intent to <br />install the fence in line with the side of the existing house closest to the side street (Maple <br />Ridge). <br />Ms. Lieber said the applicant proposes to enclose a portion of their rear yard with a six-foot high <br />shadowbox fence. Because the property is a corner lot, a fence cannot extend closer to 20 feet <br />from the right-of-way of the side street. The fence runs parallel to the side street and is located <br />approximately 11 feet from the right-of-way at the closest point, therefore a setback variance of <br />nine feet is required.
