BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF JUNE 1, 2020 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:00 pm via online public meeting. <br />Present: Eric Allain, Bob Papotto, Ralph Mackey, Suzie Patton, Dan Rahm <br />Staff. Law Director Michael Gareau, Jr., Planning Director Kim Lieber, Assistant Building <br />Commissioner Dan Russell <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of May 4 and May 18, 2020, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />20-16290; Dan Santiago; 3298 Clague Road <br />Representative: Diane Bija, New Creation Builders, 818 East 73rd Street, Cleveland, OH <br />Proposal consists of a new detached garage. Property is zoned C -One Family Residence. <br />1. A 2 ft. variance for side yard setback for a detached garage; code requires 5 ft., applicant <br />shows 3 ft., Section 1135.02(B)(1)(c). <br />2. A 7 ft. variance for rear yard setback for a detached garage; code requires 10 ft., applicant <br />shows 3 ft., Section 1135.02(B)(1)(c). <br />Ms. Lieber said the applicant proposes to construct a new detached garage. Code requires <br />minimum setbacks of 5 feet from side lot lines and 10 feet from rear lot lines. The applicant <br />shows 3 feet for both setbacks. Ms. Bija said the owner feels like he has limited grass area in his <br />yard and did not think the variance was substantial. The existing garage is located further into the <br />yard than the proposed garage and the family has suffered from the lack of common area. <br />Ms. Lieber said the lot is non -conforming in that it fails to meet the required lot width, 60 feet is <br />required and the lot has a frontage of 42 feet. It also does not meet required lot area, 8,700 square <br />feet is required and the lot is 6,956 square feet. The garage itself is within code, but larger than <br />the garage previously located on the lot. The applicant did not include rationale in the submittal <br />for why the garage cannot be placed to meet code requirements. A detached garage must be 15 <br />feet from the dwelling and anything attached to it, such as the deck. She thought the garage could <br />be moved to a location that meets the distance from the dwelling but a setback variance would <br />still be needed. <br />Mr. Mackey asked if there is a utility easement at the rear of the property, Ms. Bija did not think <br />there was. Ms. Patton asked if there is a location where a new garage could be built without <br />getting variances. Ms. Bija said it could be done by placing it in the backyard, requiring a right- <br />hand turn behind the house and removing the grass area. Mr. Rahm asked why the garage will <br />not be rebuilt in the same location, Ms. Bija said the new garage will be bigger than the previous <br />
