PLANNING & DESIGN COMMISSION <br />CITY OF NORTH OLMSTED <br />MINUTES OF JULY 8, 2020 <br />ROLL CALL <br />Ms. Nader called the meeting to order at 7:04 pm via online public meeting. <br />Present: Dave Anderson, Julie Nader, Humberto Olivos, Tom Patton, Paul Schumann <br />Absent: Greg Malone, Darrick Matthews <br />Staff. Planning Director Kim Lieber, Assistant Law Director Bryan O'Malley, Building <br />Commissioner Jeffrey Grusenmeyer, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Ms. Nader moved, seconded by Mr. Anderson, to approve the Planning & Design <br />Commission minutes of June 10, 2020, motion passed 5-0. <br />COMMUNICATIONS <br />Sign Code Update <br />Ms. Lieber reviewed the changes made since the consultant's presentation at the last meeting. <br />The definitions for setbacks and yards were updated based on the Building Commissioner's input <br />and a few clerical issues with the document were corrected. Comments from Jim Burns on behalf <br />of the Chamber of Commerce were also considered. Mr. O'Malley reviewed the recent history of <br />sign code updates in North Olmsted and added that sign codes that are content neutral are more <br />likely to be held up by the court system. Mr. Grusenmeyer pointed out that the updated code will <br />be easier for business owners and staff to understand and enforce. <br />Jim Burns said the Chamber of Commerce is pleased with the changes made to the sign code. He <br />asked that the wording in Section 1163.14(B)(6) be changed to "unsafe or declared a nuisance." <br />He was concerned that the term nuisance is not defined in Chapter 1115 and he thought it would <br />be enforced differently depending on who is making the determination. Mr. O'Malley said <br />nuisance is not a subjective term and is well defined in the law. Mr. Schumann asked if the term <br />is defined elsewhere in the codified ordinances, Mr. O'Malley did not think it was. Ms. Nader <br />was concerned about adding a legal definition for nuisance to the code. Ms. Lieber pointed out <br />that nuisance is also used in the Building Code and did not think a definition is required. Mr. <br />Olivos pointed out that "and" should be removed from Section 1163.06(P). He also suggested <br />adding "lasers" to Section 1163.06(G). <br />Ms. Nader moved, seconded by Mr. Anderson, to recommend approval of Chapter 1163 <br />Signs and Chapter 1115 Definitions as amended with the following modifications: <br />1. "And" to be removed from Section 1 163.06(P) <br />2. "Lasers" to be included in Section 1163.06(G) <br />Motion passed 5-0. <br />ADJOURNMENT <br />
