PLANNING & DESIGN COMMISSION CITY OF NORTH OLMSTED MINUTES OF JULY 8, 2020 ROLL CALL Ms. Nader called the meeting to order at 7:04 pm via online public meeting. Present: Dave Anderson, Julie Nader, Humberto Olivos, Tom Patton, Paul Schumann Absent: Greg Malone, Darrick Matthews Staff. Planning Director Kim Lieber, Assistant Law Director Bryan O'Malley, Building Commissioner Jeffrey Grusenmeyer, Administrative Assistant Nicole Rambo -Ackerman REVIEW AND CORRECTION OF MINUTES Ms. Nader moved, seconded by Mr. Anderson, to approve the Planning & Design Commission minutes of June 10, 2020, motion passed 5-0. COMMUNICATIONS Sign Code Update Ms. Lieber reviewed the changes made since the consultant's presentation at the last meeting. The definitions for setbacks and yards were updated based on the Building Commissioner's input and a few clerical issues with the document were corrected. Comments from Jim Burns on behalf of the Chamber of Commerce were also considered. Mr. O'Malley reviewed the recent history of sign code updates in North Olmsted and added that sign codes that are content neutral are more likely to be held up by the court system. Mr. Grusenmeyer pointed out that the updated code will be easier for business owners and staff to understand and enforce. Jim Burns said the Chamber of Commerce is pleased with the changes made to the sign code. He asked that the wording in Section 1163.14(B)(6) be changed to "unsafe or declared a nuisance." He was concerned that the term nuisance is not defined in Chapter 1115 and he thought it would be enforced differently depending on who is making the determination. Mr. O'Malley said nuisance is not a subjective term and is well defined in the law. Mr. Schumann asked if the term is defined elsewhere in the codified ordinances, Mr. O'Malley did not think it was. Ms. Nader was concerned about adding a legal definition for nuisance to the code. Ms. Lieber pointed out that nuisance is also used in the Building Code and did not think a definition is required. Mr. Olivos pointed out that "and" should be removed from Section 1163.06(P). He also suggested adding "lasers" to Section 1163.06(G). Ms. Nader moved, seconded by Mr. Anderson, to recommend approval of Chapter 1163 Signs and Chapter 1115 Definitions as amended with the following modifications: 1. "And" to be removed from Section 1 163.06(P) 2. "Lasers" to be included in Section 1163.06(G) Motion passed 5-0. ADJOURNMENT
